Kir. sey and Barron, for refusing bis vote in the first Precinct of the Seventh Ward at the last June election, was continued yesterday after our re- Port closed. It came out in evidence on the part of the defence that the plaintiff was registered in the second precinct of the Seventh Ward, but was refased the ground that he lived in the first precinct; and, upon trying to vote, was chal- lenged by Barron, on the ground that he lived in Georgetown, or in the First Ward; and by Kin- sey on the ground that be was a perjured man. The third judge, Mr. Mattingly, although deem- ing the plaintiff a legal voter, was overruled by the other two judges. Joseph Bradley, senior, on the part of the de- fence, did not contend the point of the right of the plaintiff to vote, but based their claim for an acquittal on the ground of an error in judgment on the part of the defendants, as to the extent of their legal powers as commissioners of election; and that. in refusing the plaintiffs vote, they ‘Were actuated by honest motives Mr. C. Lee Jones, on the part of the plaintiff. prayed the following instraction, which was granted by the court: : If the jury believe from the whole evidence that the plaintiff was a resident of the first pre- cinet of the Seventh Ward, in the city of Was! ington on the first Monday of June, 1857, and had resided in the said city one year immediately preceding the said flist Monday of June, and Was a resident of the s#id Seventh Ward, and had been returned on the books of the Corpora- tion during the year ending the 3ist of December next preceding the day aforesaid as subject to a school tax for that year, and had paid the same, and offered to vote th id first pre t said ward, ard the defendants, being two ¢ three commissioners for said preeinet fused to receive and allow bis vote, fraudu and malicior adleging ax the! so refusing te clive bis vote t jured man,” and that by rease the said plaintitt was deprived of his vote, that the said plaintiff was entitled to recover in this action, unless the jury believe that he bad been reviousty convicted of perjury ot some other | eninasee eri 7 Mr. Bradley, for the defence, then effered the following two instructious, which the Court also granted: “If from the whole evidence afi shall fied (hat the defendants. ar liberate judgiments and in good faith beltevi that the plaintiff was not entitied to voteat the time and place stated in his declaration, rejects d the same, then the plaiutit® is not ent cover in this action, aithongh the jnry may far- ther believe that the plaintitt was in fact then and there entitled to vote. “And, further, if from the whole evidence the jury shail find that the name of the plaintit! was net on the register of persons entitled to vote at said precinct at said election, and bis ward vote was challenged and rejected by one of the de- ferdants on that ground, and no if was ottcred to sbow that his name had been omitted there- from by frand, accident, or mistake, then the Plaintiff is not emutled to recover in this 2-tion, ? ALgxanpaia, Va., May 28. The election of yesterday passed off as usual. A few fights in the vicinity of the polling places were the only exceptions to the general quiet of the day. The friends of the candidates exerted themselves to the utmost, and quite a large vote bears witness of-their success in bringing out the voters. The result is a complete defeat of the candidates who @xpected success merely because of a partizan nomination, and the election of nearly every candidate who ran without party endorsement. The victory of the people in this local election over party organization is not less complete because two gentlemen who See pete the Know-Nothing nomination were elected by their own personal popularity. ‘The American party nominees were: For Sheriff, H. L. Monroe; for Clerk of the County Court, G. P. Wise; for Clerk of the Circuit Court, R.A. Sinclair; for Commissioner of the Revenue, Geo. Duffey.
