LOCAL INTELLIGENCE. Curmtxat Cornt.—When our report closed yere terday, the evidence for the United States in the case of Mary McFerson for the murder of Nancy Buckhanan het! just closed. The defence presented no evidence, but Mr. ‘Norris prayed the Court for a series of instruc- ions to the jury as follows : Sst. Ifthe jury should not be satisfied from the evidence aforesaid that the death of the deceased was occasioned by the said wounds upon her —— prisoner is entitled to a verdict of ac- quit*al “d. And if they should be of opinion that the wounds so received by the deceased were not mortal in their character, but tbat the fever which caused her death was rendered mortal by some positive supervenient cause or stimulant, inde- pemtent of, and not produced by the said wounds or heating, or other act of the prisoner, then the prisoner is in like manner entitled to a verdict of Aequittal. 3. And if they should believe from the evi- dence that the said wounds would not in their nature, had they been inflicted “eee a person of ordinarily healihy constitntion, bave produced death, but merely resulted in grievous bedily batm, although they should believe — occa- sioned the death of the deceased, they will find the prisoner gailty of manslaughter only. 4th. And although they should believe that the said wounds cansed the death of the deceased, yet if they should further believe that the pris- oner at the time of inflicting the same was moved by « sudden provocation, and had not a fo.med er aes or design to take the life of the deceased, ut merely to chastise or severely beat her, they can find the prisoner guilty of manslaughter only. Sth. If they should further believe from the evidence aforesaid, that any of said wounds were inflicted _on the deceased by the prisoner at a former day. and that the infliction of the same were provoked by an assanlt upon the prisoner by the deceared ; and it is uncertain whether the said wounds or those charged in the indictment caused the death of the deceased, they should find the prisoner not guilty, unless they believe that the said wounds inflicted on the deceased on the former oceasion were dixproportioned to the Provocation, then they can find the prisoner guilty of manslaughter ont ‘These instructions were after argument, snb- m tted to the Court, who answered them with Proper qualifications. moa aap = acting district attorney then ra the following instructions to the jury on The part of the United States, pat “Tf the jury believe fi the evidence afore- srid, that the prisoner, Mary McFerson, as .ault- ed the deceased, Nancy Buckbanan, in the man- ner and form aforesaid, to wit: with the oaken board and the chair aforesaid, either from malice springing up at the instant, or from a pre-e crived matice; and that she, the said Prison: did then and there inflict upon the said decea the mortal wounds and bruises aforesaid. of which said mortal wounds and bruises, she the said deceased afterwards then and there then the said prisoner, Mary McFersou is of murder, and it is not necessary should be satistied that the prisoner had the dis- tinct intent in fact to produce death by the blows, provided they further find from the evidence, thr seme were wilfally and violently inflicted, with tntent to do zriev bodily harm to the decased, and withont regard to consequences’? This instruction the Court answered in the some manner ay in the foregoing instructions prayed by the counsel for the defence The jury was then addressed by a1 Maury for government, and Messrs. Rooker and Norris for defence i The case then went tothe jury, who, after an absence from the court-room of one bour, re- turned with a verdict of manslaughter. There- upon the Court adjourned. To-day, the Con:t met at the usual hour, but up to the time our reporter left the Court, nothing had been done. Several prisoners were ar. raigned. but in the absence of witnesses no case ‘Was taken up for trial. that the jury Lecrere py Mr. Georex Corway —There was a full audience at Philharmonic hall last evening to listen to the discourse of Mr. Copway, the educated Yndian. The several delegations of Indians at present in the city, were on the stand with the speaker, and were objects of no little curiosity. ‘The lecture itself was full of interest, especially to those of the audience acquainted with the general history of North Ameiican In- dians. The intention of the lecturer was. appa- rently to awaken a desire in the minds of hix hearers to attempt the civilization and preserva. tion of bis red brethren in a more effectual man- ner than has yet been adepted He spoke of the hostilities between the two races. and urged that his race should not be so deeply censured on this account, as the antazo- nisin arose more by reason of the white mau's cupidity. than from any savage principle inherent in the Indians. To prove this. he urged that when the whites first came hither from Europe, they received kindness and hospitality at the bands of the red men More than this, wien different nations of whites have gone to war for the supremacy in this Western world, they ve each made use of the Indians as their auxiliaries For the decline of the Indians he accounted by the intreduction among them of deadly weap- ons by their engaging in the wars of the whites, with each other, by strange diseases, such as the smallpox, &e. One great reason why it has been found impossible to civilize the Indians, be said, was because of their being so frequently removrd from one district or reservation to another. In conclusion, he suggested a plan for the civ- ilization ard christianization of the remafnin; tribes, by centralizing them in one reserv: where they should he permitted to remain, and where the transition from the savage state should be gredual, and with a view to their physical comfort. By this means they would require few- erteachers, and could be governed by suitable laws. Their children cone be sent to school, and ultimately they would become usefal aud geed citizens Screeme Court.—Wednesday - Ino. T. Adjourned Concent sy St. Matruew’s Cuoin.—Amidst the various scenes of pleasure that promise to en- liven the ng week, the Concert by St. Mat- thew’s Choir on Monday next, holds the most Prominent rank, as an occasion which will not only afford the highest enjoyment t wiil dis- play an cffort of musicat art rarely witnessed in the metropolis or any other city of the United States. By reference to the programme it will be seen that the pieces to he performed are of the Most attractive character, and will be executed by ledies and gentlemen whose names are iden- tified with all that is exquisite in melody avd sony. Such a Concert, aside from the mere plea- sure of the hour. is manifestly a source of struction and a means of self-refinement; and will, no doubt. be patronized by all who are dis- Posed to mingle the useful with the agreeable. A Great Bitt'—To-night Miss Agnes Rob- ertson is announced to appear at the Theatre in six characters, with songs and dances, viz: “Carlo” in “Asimedens,” and ax “Mari “Hlaus,”’ “Sally Bacon,” “Fftie,” and ““Corney”* in the capital farce of *‘The Young Actress.” By the way we notice that a very desirable jm- rovement bas been made in the way of ventil- ating the Theatre, by which the surplas heat which paturally rese to the upper part of the building, incommeding more particularly thoxe in the dress circle, is discharged through the roof. The dress circle ix to be more briliiantly lighted up, and then the new Theatre will be as nearly perfect as possible in this lower world. To-night Landis and his pany appear as old style darkies, and tor better Lacrung ar tux Asszmaty Rooms.—Wednes- day evening, John Delafield, Eeq., of Missouri, delivered a lecture as above, on the Truth of Holy Writ, and in opposition to the isms of the day. The audience was small, probably on ac- count of the insufficient notice giver, but the lec- ture was certainly a most able ana interesting discourse. The lecturer an by imag ning a reapers alone at mid: it, on a river; around ‘im are the flowing waters, the dense forests, the lofty banks, and many other manifestations of the grandeur of nature; above him is the out- spread canopy, bedecked with inuumerable stars whose brightuess is reflected by the ever-flowin; waters at bis feet; no animal life is near, and, save the murmuring of the stream, as it sweeps onward to the ocean, all is still and silent. The hour is La, sineres for thoughts concerning the whereof and the wherefor of all things that exist. and what is to be the condition of the mental part of man in the unknown future. Under such circumstances the mind is liable to enter voluntarily upon speculations, and accord- ing to its degree of intelligence will its notions be irrational, or in accordance with Divine revel- ation. The starting point for these r flections is apt to be the mutations which matter is observed to be continually undergoing ; and fiem this we are naturally led to consider what is the source of = and to what will these changes ultimately ten ‘The speaker roceeded to show how the intel- ligent mind is thus led to recognise and accept Divine revelation, while those inclined to dis- ute the truths therein set forth, become involved na Jabysinth of inconsistent’ philosophisings, from which, because of the vastness of the sub- ject, they are totally unable to extricate their thoughts, and will, in all probability, settledown on some ernde system of infidelity. The fool- ishness of the so-called systems of Philosophy, founded on infidelity, was’ next illustrated, and the large share of credulity necessary for their belief remarked. The lecturer then examined several of these systems, and called attention to the fact that while they appear consistent with some of the developments of science, they are fo to be ia other particulars totally at vari- ance with the same. The revelations of Holy Writ were then con- sidered, in connection with the sciences, and it was shown that, so far as all established facts are concerned, there is no disagreement between the two. It is trne that they do not, however, always agree with speculations of scientitic men For instance. the Bible is disputed because it is said that geology proves this world to have existed for a much longer period than that assigned it in the Mosaic account. Geologists contend that the earth was first a mass of molten matter, and the outer crust gradually became cool and hard. This the lecturer thought irrational, as it does not permit the existence of water on the earth and the atmosphere to be rationally accounted for. They say that the inner portions of the globe are still in am incandescent condition, and gradually assuming solidity; but the mines in the Carpa- thian mountains and the deepest sea soundings prove that the deeper you penetrate the earth be- hey a certain distance, the more intense is the cold. The notion that there bas not been time suffi- vient, allowing the Mosaic account to be true, for the light from many of the fixed stars to have reached us was exploded ; for, said the lecturer, the passage of light throngh space ix instantane- ous, and it is only throngh the sixty-four miles of atmosphere surrounding our earth, that light meets with obstructions As a whole. the lecture was a powerful argu- sument against infidelity, and displayed great mental labor. Mr. D. lectures avain te nighe on the isms of the day, the object of the discourse being especially to show the fallacy of spirit- ualism and other recent wonderful doginas. EXAMINATION OF ANDERSON AND RAWLINGS Yesterday afternoon, Luke Anderson and Wil- liam Rawlings, who were suspected of being concerned in the murder of William Griffin, at Aquin Creek, Stafford county, Va , on the 2ith of December, 1-57, were taken trom the county jail to the seventh district police office for a hearing before Justice Donn. ‘The prisoners were incus- tody of Constables Allen and Boss. Daniel Rat- clitfe appeared for defence. A number of wit- nesses were examined but nothing was elicited implicating the prisoners, and they were dis- missed by Justice Donn for want of evidence to justify holdingthem. Th: suspicion against An- derson appears to Lave arixen merel nm the fact that he was at Aquia Creek on Christmas eve, the date of the murder, and that he came away rather hastily: but acause for his sudden departure was shown in his being ill and wish- ing to get back to Washington as speedily as possible ‘Tue Weatner.—Range of the thermometer trom Thursday noon, Jan. 21, to January 28, Morning.
