LOCAL INTELLIGENCE. Camixat Covrt —Judge Crawford.— After our report closed on Saturday, the Court took up the case of the United States es. Jobn Baptist, wherein the defendant stood charged with stweal- ing sheets, a tin pan, a pillow-case and two shirts from Mr. John Kelly. Found guilty as indicted. The next case taken up was that of the Us. evs William Nicholson for assault and battery on James Moore with intent to kill him on the 224 of tast July. The facts given in evidence were— that the defendant and the man Moore both be- longed to a fishing vessel in Georgetown ; that they were both drunk on the night in question ; that Nicholson accused Moore of stealing a pis. tol; that Moore made a similar cbarge against Nicuvisoa. Moore being on the wharf, dared Nicholson, who was on the vessel, to come on sbore and fight him. Mutual invitations to fight were so exchanged, and finally Nicholson went on shore and the parties clenched and a scuffle ensued. A moment after Moore cried out that he was stabbed. Assistance being called, and lights being procured, Moore was discovered to be fin the abdomen. He afterwards died from Summer disease, and while bis wounds ling The defence endeavored to make it ar that the disease was in the system of Moore af the time of the stabbing to show that the indictinent should be quashed. If such was the faet, they contended that the indictment she have beea for mansiany liter instead of as- sanit and battery ructions to this effect were prayed by the counsel for the defence ‘The cave was closed and went to the jary at 3 o'clock p.m. John Baptist was told to siand up for sentence. The Court stated that inasmuch as Baptist bad been in jail for four months, the sen- tence of the Court was that he be further impris- oned in the county jail fora space of tive months, and pay a tine of Sf. The jury here returned in the case of William Nicholson a verdict of as- sault aud battery only. This was an action under an opinion of the late Attorney General, Gen. Cushing. ‘The fees of the Coroner were paid by the Levy Court under an act of Ma- tytand of 1799 until the year IS, when by the Sth section of an act of Congress creating the Criminal Court, the same fees were allowed to the Coroner and jurors, and witnesses summoned by Lim on any inquest as are allowed to the Mar- shal of the District and the jurors attending the Chrevit Court. Under this act the Coroner and jarors and witnesses summoned by him were paid out of the Treasury of the United States until 153, when Mr Cushing decided that the Usited States was not, but the Levy Court was bound. This case was argued with great ability on the part of the plaintiff by Messrs J. H. Brad- ley and WR. Woodward, and by Mr. A 8 Cox for the defence, but the opinion of the Court was not given on Saturday. ‘To-day the Court met at 10 o'clock, and Mr. Kennedy, for plaintiff's, appeared on a motion for a new trial of the case of Hewitt rs.
