Mr. Key detied them, or any one, to point outa single line in the affidavit of — Goddard that ‘Was not as true as truth itself. He went on to argue that the Mayor was acting in strict com- plance with the oath which he had taken to see the peace maintained. He also took up and refa- ted the charges which had been made by the counsel for the defence, against Capt. Tyler and Justice Donn, of falsity in their evidence. He went on to show that the gun was tuken to pre- vent bloodshed, and that Captain Tyler, through the whole of the affair, had been actuated by a desire to save life and prevent the rioters from disturbing the e; although he was exercising # reluctant and necessary duty, by the orders of the Executive of the country, yet he was held up before the Court and to the Jury as a murderer! Mr. Key went on to review the distinction which had been drawn by the learned counsel for the defence between a riotand an affray, showing that this occurrence which was now being inves- tigated by the Court was clearly a riot. He alla- ded to the remarks of the counsel with respect to the early arrival of a particular class of voters at the polls being unlawful. This notion he held to be simply absurd. Was it to be believed that those who came late to the polls had a right to drive the voters already there away from their Positions because they had yot there before them and taken their places. It wes a curious idea of the counsel that the voters who were on the ground first were the aggressors, and shat their early presence there was the cause of the disturb- anee which there occurred. He went on to ad- vert to the endeavor of the counsel of the defence to establish an idea in the Court that the presence of Justices Goddard and Donn en the ground tended to excite the crowd, as showing how the counsel bad undertaken to distrust the facts that had been given in evidence. With regard to the commissioners of election, Mr. Key said that if they would come back and state to the jury that at the time they closed the polls they were actuated by fear of their lives, and would give any other reason for that act, he would be the last man to characterize the act as unlawful or criminal. But on the cont the commissioners had concerted toyether and r- mined beforehand to close the polls. They did close the polis before the marines had passed Shreve’s stable, and the only excuse they had pre- tended to give for the act was the presence ofthe marines who had not then arrived. With regard to the testimony in relation to the firing from and upon Alston‘s corner, Mr. Key went on to say that the evidence of Mr. Birkhead was positive and uncontradicted as (o that matter. The defence had endeavored to disprove dence by a host of witnesses, who ail ited that they were standing on that corner, and had such a thing occurred as the firing of a pistol or the throwing of stones at the marines they would have seen it. In answer to all that he adverted to the peepee of a marine who had fired upon that corner, and had stated to the jury that at the time of firing, and for some time previous, the view of that corner had beeti obstructed by rea- son of the smoke which came ering down from the right of the line where the fit ‘hitmen oing on. How. then, could these witnesses are rouzh the sinoke? and even allowing that they could see, how could their view be suttic ientl zecurate to bave seen the marines with their mus- kets leveled at them? One of these accurate wit nesses had seen the muskets of two men pointed from two extreme angles, and looked down the barrels of these muskets at the same moment of time. Were such statements to be believed in the face of all these inconsistences? The idea was abwurd Mr. Key then closed by saying that he would Kive the case to them, and poe a. them to weigh the evidence om both sides, and render a verdict as they mizht find the facts justitied. He cau- tioned them to set aside, above ali things, party [ hipar nen and come to the issue upon the facts nevidence. If they found any of the defendants to be Know-Nothings, and any of the jury were Know-Notbings, convict them, and rid taal part of a set of riotous and lawless men, who would = the party to inevitable ruin ; On the other hand. if any of the jury were Democrats, and they found any of the defendants to be Democrats, convict them by all means, and rid that party of such useless and worthless encumbrances. She was built and rigged by her captain and owner, Mr. Webb, in Connecticut, and by bim and one man brought safely across ‘the stormy Atlantic in 37 days. She started with the captain and two men, but one of them was unfortunately lost overboard the first day.
