"VENING STAR. LOCAL INTELLIGENCE. Saconp Tarat or Hersert.—Seventh Day. Yesterday, after our report closed, the argu- ment upon the instructions proposed was con- tinued by counsel. Mr. Key’ contended that the instructions given at the last trial shut out the circum- stances of the conflict of Herbert beginning the affray with a deadly weapon, and of Pat- rick Keating seeking to defend himself by wresting the deadly weapon from his grasp. The instructions of the defence ask nee shut their eyes to the anterior peril of Patrick Keating. Mr. Walker followed and stated that Mr. Key had confined his citations to a very few standard authorities, but that Mr. Preston had s large number to offer to which he would not have the opportunity of replying. He sup- it would only be pro-forma proceeding, a3 far as the Court was concerned, the ques- tion already having been decided, but that the argument was intended by the prosecution to affect the jury. . After Mr. Preston had announced the thorities to which he should refer, Mr. ker proceeded, in an argument of two hours, to oppose, with great ability, the instructions proposed by the prosecution. The great question for the Court and Jury, there, was the ascertainment of truth, no matter how it effected the dead or the living. If blood was Herbert’s object, why did he not use the pistol when he first approached Tom Keating? The theory of criminal prosecutions, he contended, is this: that the sole object of Government should be to ascertain the truth and where it lies; not prosecuting the case with severe rigor, nor seeking to influence the Court by instructions. Mr. 5 re followed in a powerful argu- ment, which occupied the closest attention of the audience until half-past sixo’clock, p m. Mr. Preston contended that the opinion of the Court might be modified. It did not fol- low that because the Court had granted prayers on the former trial it should not grant additional ones on this trial. The uncontra- dicted proof shows. he urged, that Herbert called for his breakfast in a rude, unkind, and ungentlemanly manner. It was admit- ted by Gardiner, and all, that Herbert ap- proached the waiter with a loaded pistol. In legal acceptation this ES igo upon the waiter was an assault. Upon the opening of the Court to-day, his honor Judge Crawford gave his decision —— the six | sae ety ane ag instructions*) asked by the United States, as follows : Qualification to the first instruction.—The instruction prayed above is abstract. It pre- sents a naked proposition without reference to any fact disputed in the case, or any fact sworn to on either side, except only the pre- eence of the prisoner at Willard’s Hotel on the 8th of May last, having a pistel in his pos- session, and the shooting by him of Thomas Keating, which facts are not contested It is the duty of the jury to give their verdict on the whole e mee adduced on this trial, and on that only, in connection with the law as it shall be given to them by the Court. The Circuit Court has decided uniformly that the Court is not bound to grant an abstract in- atruetion, and the same Court has gone so far as to decile in a case which went from this Court, that the Judge, in answering a prayer, give an opinion when he modifies the instruc- tion asked for on an abstract point of law, it is error. Second. The jury may believe the above statement of facts and yet the defendant not be guilty of manslaughter by reason of addi- tional facts which the evidence, in the opinion of the jury, may have established. If so, all the facts are to be weighed together by you The prayer sets forth not only a part of the evidence, but so emall a portion of it, as to have very little application to the case. It exoludee all the material facts that have been sworn to on both sides, and which are in con- troversy. All these you are to weigh and decide upon. The case sup would be manslaughter, but unless all the testimony on either side is thrown out of view, it is not this case Third. The above statement of facts would make a case of manslaughter if they are be- lieved by you from the evidence, but it em- braces only a part of the evidence, and as already remarked, it is your ‘ial pro- vince to draw your conclusions of the guilt or innocence of the accused from the entire body of testimony, and to give credit or not to any ‘one or more of the witnesses on either side. Fourth. On the statement of facta in this prayer it is granted. But the Court thinks the first statement in it is capable of miscon- struction as to the nature of the assault said therein to have been made by the accused Sy the deceased with a deadly weapon hether there was such an assault and if there was, what was its nature, whether the pistol was pointed at deceased and used as a deadly weapon, or whether it was used as a man might use a stick or other instrument are questions for you to decide, and this and all other —— involved in the cause trying, you will determine, not on any partial state- ment of facts but upon the whole evidence.
