The Intelligencer again calls on the Union to name the partieular case in which it recent- 1y became the duty of the Attorney General to give an opinion upon the Constitution doc- trine of State rights—basing its request on an intimation that it conceives the subject to be one which should not be approached by the Executive branch cf the Government, except under circumstances of pressing necessity. We have received a communication from the counsel of the Accessory Transit Company of Nicaragua, reviewing a recent article th the Star upon the current difficulties in Cen- tral Ameriea, which we shall publish on Mon- day, it having come to hand at too late an hour for insertion to-day. ee WASHINGTON NEWS AND GOSSIP. Our Government is not thus lax in the enforcement of law when the stronger Powers are interested in itsobservance. With reference to the Jourital’s comments on the matter, we have to say that while we agree to all it says concerning the conduct of the Americans who have perpetrated these outrages, we know that it does the Govern- mect injustice, The Administration did expend all its lawful power and means at its command to put it out of Walker's power to invade the Territory of Nicaragua. They caused him to be prose- euted to the extent of the law for his Sonora exploits, aod were defeated in that prosecution only through the obstinacy of Mr. French-Con- sul Dillon, who refused to testify in his case ; that person’s testimony being absolutely necessary to procure his conviction. It was thus through the illegal conduct of the repre- sentative of the French Government on the Pacific side that he was enabled to get off, so as to organize aud set out on his present expo- dition from a point so far remote from the practical authority of this Government in such an affair, as to make that authority vir- tually a nullity. Mr. Dillon’s conduct was as all the world knows, immediately made the subject of proper representations from this Government to that of France; and though the result has already boen an insurance against the repetition of any such conduct or the part of a French Governmental agent in the United States, the mischief done in the particular case could not be repaired; as Wal- ker’s present position prover. Though France and the notorious non-cf- ciency of our system of government so far from its centre in precively such a case, have alone produced these results which are so much to be regrettcd—and though the respor- sibility for it is, therefore, cff the shoulder: of the governmeat at Washington—those who have noted its conduct in all such affairs need hardly be assured that Walker and his allie, natives of Nicaragua, will receive no aid and comfort, direct or indirect, from this poi Under the ciroumsisn ses, the fact of Walker's complicity with any native partics assuminy to be the government of Nicaragua will prob- ably be deemed a sufficient bar to theiz receg- nition, by the present administration, as tie government of that country; unless, under circumstances absolutely compelling such re- cognition, (by no means likely to occur,) or the entire abandonment, in this particular case of the admitted, and heretofore inflexi- bly administered rule cf conduct of the United States government in its intercourse with un- settled foreign nations or powers. The New York Commercial Advertiser, in commenting on this maiter, takes oceasion to say: * For though the United States Government may be free from all blame in the Kinney and Walker affairs, it will not be easy to make the Nicareguans believe it, or understand how s Government, ct. rg to bave the popa- lar support and the executive authority which ours te. ean be powerless to prevent such roceedinzs on the part of its citizons. They now, deubtless, how long the Kinney expedi- tion was talked of publiciy, and defended and applauded by some portion of the press, while the Government seemed to be an uncon- cerned epectator of the prolonged prepara- tions. Nor will SE be unmindful of the fact that Mr. Pabens, Kinney’s alleged partner, was long an Ameri al; that he took rominent part in forcing the Administration into the Greytown enormity, and was still re- tained in office, until his palpable indisere- tions compelled the Government to remove him; that his successor soon betrayed the same affinities and purposes; that Colone! Walker had previously made a wretched pi- ratical attack upon Sonora, and though since havirg been within the jurisdiction of the United States Government, had suffered no penelty for the offence; and that a new de- tachment of armed men from Sin Francisco had been permitted to embark to join him, aud were on board the very steamer on which the alleged outrage has been committed.” Our explanation with reference to the part of the business transpiring in California and on the borders of the far distant and compara- tively unsettled State (so far as the duo exe- cution of the neutrality law is concerned) need-notebe repeated here in answer to the Advertiser. So far as concerns the eases of Kinney, Fa- bers & Co., concerning which it now com- ments so indignantly, we beg to call its con- ductor’s attention to the fact that but for the faux pas of the United States judge (Inger- soll) in permitting himself to be hambugged by Kiuney, against the advice and due warn- ing of the government here, as we explained at the time, they would now be in prison in New York, and not, as they are, disgrasing usase@ ration. Quf respected contemporary of the Commereral Advertiser will farther recollect how severely it took us to task for our indignant comments upon tbe foolish con- duct of the judge in that case; which it charged on the government here, as an im- proper effort, to interfere with the indepen- dence of the judiciary. The tone of the papers in question, in view of the fact that England has about as much to attend to in her current war as she can manage without momentary danger of national bankruptcy, is silly beyond comparison The cause of our offending, according to them, is the fact that our people sympathise with Russia rather then with the Allies; and England, on that account, is preparing to chastise us. Bosh! Our wonder is that we have men among us claiming to be intelligent, who do not com- prehend at a glance that England would pre- fir any yossible contingency whatever just at this time, to that of forcing the United States into the position of an alliance with Russia. From what we hear, as coming from parties in New York, who are eanstantly in the re- ceipt cf advices with referenee to the acts of the British Government, the enmity to the United States expressed by the English pa- pers in question, amounts to a faithful refiec- tion of the present tone of the British Govern- ment’s feeling towards our Government.
