ALASKA FISH CASE ARGUED, HIGH COURT By CHARLES D. WATKINS WASHINGTON, Oct. 22—#— Counsel for Alaska Salmon Packers argued in the supreme court today the Secretary of Interior Mad ex- ceeded his authority when he in-| cluded 3,000 feet of off-shore water in an Alaskan Indian: reservation. The off-shore water is included in a reservation created under the| Wheeler-Howard Act for the Karluk | Indians on Kodiak island. | The salmon packing companies | were warned not to fish in the twaters but disregarded the order. | Then the Fish and Wildlife Serv- ! fee included in its fishery regula- tions for 1946 a prohibition against Anybody but the Karluk Indians and their permittees in the restrict- | &d. waters. Injunction Obtained The packers obtained an injunc-, tion in an Alaskan district court re=! finmmg the Service from enforc- g the prohibition and the Ninth uit Court of Appeals upheld that | Qecision, This action was appealed to the supreme court. W. C. Arnold and Frank L. Me- chem, attorneys for the packers, hfgued the Secretary of Interior had no authority under the Wheeler- | Howard Act to include coastal wat- ers in an Indian reservation. | They contended the Depnrl.mem; could not use penalties of the White | Conservation Act—which fixes hea- yy penalties for violation of Alas- kan fish conservation regulations— | to enforce regulations setting Up an| Indian reservation under another ! law. i | Government’s Argument i Roger P, Marquis, government | copnsel, contended the lower courts erred in holding the Wheeler-How- Act does not authorize the In- terior Secretary to include "sub-; merged coastal lands” in the reser- vation and in holding that the White | Act prohibits the granting of ex- clusive fishing rights to the Karluk Indians. The packing companies which won . the favorable decision in the lower courts are: Grimes Packing Co., Ko- diak Fisheries Co., Libby, McNeill| apd Libby; Frank McConaghy and | Co,, Parks Canning Co., San Juan; PFishing and Packing Co., and the| Uganik fisheries. A decision will be rendered later.} e, .
