Bt i COURT FAILS TO | UPHOLD AP BID AGAINST RADIO Right of News to Gath- ering Agency SEATTLE, Dec. 20.—Acknowledg- ing evidence submisted which indi- icated that radio station KVOS of Bellingham, had “pirated” news belonging to the Associated Press, Federal Judge John C. Bowen has refused to enjoin the station from making such use of dispatches published by newspapers. The court held that the Asso- ciated Press and its member news- papers have ‘‘no property rights | for any time whatever in news re- ports after they are published.” Judge Bowen also dismissed a tem- porary order restraining == KVOS from using Associated Press dispatches taken from the Belling- ham Herald, Seattle Times, and Seattle Post-Intelligencer. The court held that the staiion | might pick up local news after the same had been distributed to the | public in the regular manner. The court found the “improved metih- ods” of disseminating news “mpst (not be discarded the same as:pgi- | vate enterprise unless such hinders ance of public interest is required by positive law or a clear con- tract.” 3 Judge Bowen remarked that Con- gress must “abridge public inter- est in favor of private enterprise” before a finding could be made in favor of the defendant, but add- ed that Congress has not seen fit to do so. He said the case might be different if KVOS were selling news taken from Associated Press newspapers to other broadcasters. The Associated Press contended that the broadcasting of news en- the radio, because the public would listen in expectation of hearing news reports. The court said the station broadcasted news free of charge, whereas newspapers get paid for both subscriptions and ad- vertising. B. Lesher Tuesday afternoon for the Club's annual “Mend-It” party, spent a busy two hours with the net result that a huge laundry basket was heaped high with colorful packages, each filled with a gift for a tu- bercular patient at the Govern- ment Hospital. So lavish was the | supply of toys and books that the | committee was able to produce at least two lovely gifts for each lit- tle patient, and in addition to these, sufficient books were con- tributed to give reading matter to | children of all ages for weeks to come. Tanks and tractors, trucks and trains, with a plentiful supply of dolls so that every little girl in the tubercular ward will receive one, dressed in brand new Christ- mas finery, and mechanical toys destined to gladden' the hearts of those convalescent enough to run about made up the generous sup- ply, but for children who are still bedridden, there were puzzles and games of all descriptions, as well as plenty of busy work to while away the tedious hours in bed. This was’ the fifth annual ‘“Mend It” party which the Club has held at Mrs. Lesher's home, prepara- tory to supplying the treat for tubercular patients. An unusually Jarge number was present yester- day, however, and as a fitting fi- nale | tass ous refreshments. s assisted by Mrs. an\( H'\:-u\ Mrs, W. W.
