Asis well known, 9 contest for the contre! of tho rond ling existed. for n long time between the Gowon and autl- Guwan factions. ‘The motive for the applica- tlon for an Injunction was to give Gowen tine to return home from England and voto Mls proxies. John G. Jolinson and James. Gowen, ot Philadolplin, represented tho ‘petitioners. Thoy were opposed by Avhbel. Green, of New Jersoy,. John 8. Bullett, of Philndelphta, and John J, Me- Cook, of ‘New York. ‘The argument was opened by Mr. Johnson, who held that tho Court should enjoin the meoting on account of Mogality, Counsel on the other side con- tended that tho Board had knowledge of the meoting a year ago, und that, In doubting the Jegallty of the placo and time, the’ petitioners were asking to bo justified In disregarding . Proceedings witch hud beon acquiesced in by both. partles. Mavying concluded a speech pf fathorly advice to tho hostile {actlons, Judge MeKennan made the: following. formal orders’ ‘Iho motion, or potition, of the manngers for leavo to postpone the election of officers, ote., having been’ argued by counsel and heard by the Court, the Court refuses tho same.” “Mr. Bullett thoa inquired if ho would bo empowered to ask for a man- aninus tocompel: the other sido te hold tho election on Monday, provided this became necessary, ‘The Court ropiied: aftirmatively, but said It would hardly be necessary to' take such n stop. Messrs. DECREASE IN EARNINGS, ‘Tho earnings of the Chicago & Alton for the fuurth week In December were the most unsattsfactory for the year, inasmuch as It was thu only week during the year that thera was n-decrense over the corresponding po- riod of the previous year. The gross enrn- inga from Dee, 23 to 81, 1880, were $110,041.06, aginst $125,057.05 for the corresponding period {n 1879, making a decrease of 815,- 016.09, ‘The decrease on passenger business anonnted to $1,711.51, and on freight trafic to $13,500.12. On malls, ete, thero was an Ineronse of $261.44, * It will be seen that nearly the entire de crease Is on account of freight business, and ean thorefore not be ascribe to tha existing war on passenger rates, ‘The principal cause for tho falling off In business Js, that tho cainings for the corresponding period Inst year were unusually heavy, Had {t not been Tor the fact tint business fs also very Feo at preenkand the returns Inrge, the decrenso n earnings would be far more serious, . It Is not the Alton alone that shows a falling olf in earnings. Every road in the country, with the probublo exception of tho North- western and Milwaukee & St. Paul, on which nes the business (uring 1870 was light owing ton wheat fallura inthe Northwest, has been showing a decrease in oarn' during the Inst few weeks. It is genoraily anticipated that afl the roads in the country willshaw x steady falling off in carnings luring 188t, and should the crop next sum- mer prove f failure, the decrease In revenie would becoine rather serious, especially to such ronds that have inerensed thelr capital stock and Jonded themselves up with anumber of unprofitable branches. During the lasttwo years the yields of products haye been cnor- Inous, and’ owing to the Bontral prosperity the entire country, and particularly the West, has been gridironed with new ratlways. This makes the contributing territory ta the older lines muel sinaller, na tho now lines will take away more or less business, nn therefore, even with another stich enormous crop as during thy last two seasons, the busi- ness for 1881 must. necessarily fall off con- siderably for cach line, though not in tho aggregate, The gross earnings of the Chi- cago & Alton: for the year 180 were $7,081,253,18; for the year 1879, $5,755,077.20,— showing an Increnso for the yenr of $1,025,- 575.08, It was gepornally. ante pated that thy total Increase in“carninys for the gene 1880 would run up to $2,000,000, But the sudden falling off In business during the Inst few weeks made tie carninne Iatl short about $75,000 of that amount. Sull, the Increase In earnings forthe year is cnor- mous and without precedent on this road, ¢s- pecially when it is considered that not a mile of new road was added to. the Hue during the year, . : STOCKHOLDERS DETEATED, Spectat Dispatch to The Chicapo Tribune, Nasuvinte, Tenn, Jan. 6,—The case of the minority stockholders of tho Nashville, Chattandoga, & St, Louls Railway against ‘the present, minigement of that road and the Louisville & Nashvillo Railroad Com- pany, which has been occupying tho atten- Uon of the United States Clreulé Court for two days, was abruptly terminated this morning, Counsel for compiainant had con- sumed the greater portton of yesterday, and it was expected thet It would require one day or more for the several counsel for de- fendants to presont arguments for that side, But, upon taking the bench this morn- ing, Judgo Baxter stated that further argu- ment was unnecessary, os the Court had conelnded, counsel, to disallow the motion for tho ap- polntmenit of a Recelver to take charge of tho Nashville, Chattanooga & St. Louls Rall- way. ‘he case was-one of tha most impor- tant over brought in ‘Tennessee, It was un application by several of the minority stock- holders of the caplint stock. of tlie rond against the present management and tho Loulsville Road, which owns a majorit: of the stock therein, to take the former rule rond froin its present officials and put. tt in the hands of, Receiver, for tha reason that had no anthorit; to stock,—that 1¢ was bought by a corrupt Aprcuinent botwveen that C OMmpany nnd savers Directors of the Chattanooga Roa. ‘Tho Court, In rendering judgment, announced thatitdid not consider tt necessary in the present application to pronotnce any opinion ‘as (9 tho lesality of the purchase of stock by the LonisyUle & Nashville Rattrond Con- pany, Nor was lt proper now ever to hear the question argued, For the present t, was sufiicient to say that, In the Spon of the Court, before n Recelvor would be appointed to tnko the property froin ita present mannge- ment It iust be satisied that there was some betrayal of thelr trust by which it was prob- ublo the property of tho complainants would bo Injured, and that the rallrond had been controlled by the presont officials fairly, eco- nonilcally, prudentiy, and honestly in the In- terest of ntl,—stockholders of the iwinority as well ns tha mmaforttye cand not In the ine terest of the Loniyvilie & Nashvillo Raflron Company, An order was accordingly drawn flaauline its motion fora Receiver and in- nection. ALL FIXED UP, Spectat Dispatch to The Chicago Tribtinee Rocursren, N.-Y., Jan, 6.—The long con- troversy between tho Central & Hudson River Rond and tho clty about the clovation of the track, which hinged on the location of tho depot, finally reached a conclusion to- day, Mr, Vandorbilt and the City Commia- stoners sign a contract next week, and the work commences in the spring, ‘Tho Com- missloners to-day by a voto of 7 to 6 con- ceded the rallroad the right to locate tho depot where It soes fit, but with the tacit un- dorstanding that It be located In the central partof tho city. It !s not stated if thls be the geographical or population contre. ‘The googtaphical centre leaves the depot where it now 48; the population contre would prob- ably take St several blocks vast, or where the Company have wanted to locate it. ‘Thecon- {est over the matter has bean constant since Inst April, pit it 1g belleved tha conclusion reached will be satisfactory to all parties, . NO MONE OHSITRUCTIONS, Spectat Dispatch ta The Chicago Tribuns, Pmaperruta, Pa, Jan, 6—That the ob- atruction of the Baithnore & Ohio trains in the Ponnsylvanta’s yards hereare aluply the following out of certain specific orders from headquarters has becn conctualvely nalled by the modification of the delays which may be sald to have gone into effect the tirst of the present month. Tho day express-train between Now York and Wash- ington has not this week been detained any longer than to pormit the Pennsylvania Iinited train to get ahead of thom, and are then sent forward with the greatest dispatch, Things on the Phtindet pti, Witiningtan & Balthnore, betweon Philadelphia and Baltl- more, fre also very materially tmproved, and to nll intents and ‘purposes récelye the sane prompt atiention aecoried the tralns of the Pentisylvanin. The New York and Wash- ington business of the Baltimore & Olio has largely {neronsed the presont week, and, with tho line fully established, thero ly nu ques- ton ng to its gotting Sts full share of tho business. - TIE WESTERN INDIANA. The Chicago & Western Indiana is now double-tracking {ta line from Auburn (Wa- bash Junetion) to the Twolfth street depot and freight-house, and the work 1911) be com- pleted Ins week or two. Work on the Grovo street link fs nlso to be commenced in a day or two, ‘fho Inst condemnation ,sult for property in that sectlon is now on, and will probably be onded to- day, when work on tho Grove street section will be commenced, It {s enleulated that this aection can be cumpleted-within ten days, whan the Western Indiana will haye its own tracks all the way from Dolton to Twolfth atrect, of which that portion from Auburn Junction to Twelfth street will be donbie track rond. After the completion of this work the Wa- bash can have no further exctise for not runs ning into the Twelfth-Street Depot, and it is therefore fair to presume that it will inake ‘Twelfth street its terminus before the end of this month, Whether the Wabnsh will then recede from }ts position of charging St less than by any other jine or not remalns a mys- tery, —Prestent Itumphreys srys that his roud will then charge the same rates as are charged by other Ines, but other oflicinis of therdad say they donothelleve any such action will be taken, Should President Humphreys stick to Ins word, and the presumption is that he will, the war on. passenger rates be- tween the Western Hnes must necessarily come to an end,.and rates will be restored to aboutthe figures at which unlimited tiekets haye been sold during this contest. ..
