The Democrats Finally Drop the Spofford-Kellogg Case for the Present, Having Reached No Decision but to Agree to Disagree. Several of the Prominent Senators Determined Not to Be Bulldozed, Believing the Case Has Al< ready Been Settled Be- yond Recall. A COMPROMISE. ‘HE KELLOGG-SPOFFORD CASE. Spectal Dispatch to ‘The Chicago Tribune. Wasnrxerton, D. C., April 10.—The Demo- cratic Senators were in caucus again to- day for four houts, and the result of the three days’ conference ‘is what is called a com- promise. The Senators have decided not to vote to postpone the Spofford-Kellogg casa until the next session, and have agreed that it shall be taken up this session about the 20th of April. It is not so clear, however, that the decision of the caucus is to be regard- ed as an affirmative declaration that the Kellogg case shall be considered now. On the contrary, the decision appears to be that the regular business is to be followed until the 20th of April, within which time final action is to be taken upon the Geneva Award Dill, and that on the 20th discussion of the advisability of proceeding with the Kellogg case may be revived in caucus. THE ARGUMENTS to-day are said to have been very animated, and in the general line of argument of the preceding caucuses. It was today made more clearly apparent, however, that there areanumber of Democratic Senators who on constitutional grounds are opposed to the reopening of the case. In the course of this debate it was made definitly to appear that the following Democratic Senators do not believe that the case can ¢on- stitutionally be reopened: Thurman, Bay- ard, Lamar, Pendleton, Ransom, Hampton, and Butler, of South Carolina, These Sena- tors all expressed themselves to that effect in caucus to-day. They did not, however, zo so far as to say that if the Democratic ma- jority should decide to unseat Kellogg that they would i BOLT THE CAUCUS DICTATION. It would be very extraordinary, however, for some of these men to take the position that they have taken, and yet, if a final vote does come, to vote with the faction Jed by Ben Hill, Saulsbury, and Jonas. Should the Democrats press this case to a vote it would only be necessary for four Democrats to vote with the Republicans to prevent the success of Ben Hill’s plan to unseat Keliogg, and fully twice that number are known to be opposed to such action, To this number must be added David Davis, who, although he does not attend the Democratic caucuses, for once 13 VERY OUTSPOKEN, : declaring that if any case was ever res adjud- icata or a settled matter in the Senate, then the title to Kellogg’s seat is one. Probably one of the most amusing speecbes in the caucus to-day was that of Saulsbury, of Delaware. This fussy old gentleman is Chairman of the Elections Committee, and his notions of the dignity of his Chairmanship and of the importance of his Committee are only equaled by the intensity of his parti- sanship. At all these caucuses he has re- sented the interference of Democratic Sena- tors with the Elections Committee. Sauls- bury to-day asked the caucus how they were to regard the money expended in the investi- gation of the Kellogg case as an investment if the case was not to be heard. A great deal of money had been spent, he said, and was that 4 ALL TO BE THROWN AWAY? The decision probably amounts to a post- ponement. The advocates of immediate consideration of the case, led by Hill, Sauls- bury, and: Voorhees, were numerically in a majority and might have carried their point, as it seemed yesterday they would, but the conservatives, who are opposed. to reopening the case, together with others who are utterly opposed to taking up the case now, nade a threatening demonstra- tion which brought the majority to terms. At is understood that there are at least ten Democratic Senators who, rather than allow the case to be precipitated on the Sen- ate, will support Kellozg. This amounts to A DEYEAT OF THE OTHER PARTY, who, in such a contingency, would find them selves in a hopeless minority. Gordon made a strong speech in caucus to-day, in which he said that, if forced to act on the case, he should vote on its merits. ‘The vote by which the decision was reached was 17 to 14. THE COUNCIL. * To the Western Associated Press, Wasuincton, D. C., April 10.—The Demo- cratic Senators were in caucus to-day four hours, The question of taking up the Spof- ford-Kellogg contested-seat case was thesub- ject under consideration, and_the discussion continued with a good deal of animation and spirit. Senators Bayard, Lamar, Gorland, Jernan, and others spoke against the present consideration of the Kellogg case,’ while Saulsbury, Hill, Vance, and Jonas again_ in~ Sisted it ought to be brought before the Sen- ate for action without delay. The arguments Were much the same as before, except even more determination was shown to~lay by the advocates of iminediate action.
