S a : SALE OF REAL ESTATE UNDER MORTGAGE. | To the Editor af The Tridune. - Cxrcaco, Aug. 18.—In your issue of the 15th inst. 2 correspondent signing himself “Justice ” finds fault with the act of the last session of the Illinois Legislature respecting sales under trust-deeds. Whatever else the Legislature may have done, the measure complained of is not to their discredit. Justice says “it is un- just and inequitable in the extreme.” *Tt will put more business upon courts: already crowd- ed,” and is ‘enacted exclusively in the interest of lawyers, and not at all in that of the public at large.” Z ‘The principle of- the act is by no means a new one. It has been tried, and tried successfally, elsewhere, but your correspondent looks at it from one point of view, and one only, and that is the view of the creditor. He complains of the enabling of attorneys to interpose between debtor and creditor. Now, ‘under the old system of allowing the creditors to sell the land of the debtor, an attorney gen- erally interposed, but it was the attorney of the creditor. Under the ac: in question it is tho Court which iuterposes, ana interposes for the benefit of the debtor, aud no more costs can be charged him than the Court allows. ‘*Justice” instances a case where he says the costs were $100, the mortgage debt being only $100. It may be Poseiile, that -he gives the correct amount of costs, but they would have been uo more had the debt been $4,000 or $40,000, the same process having to be pone through in either case, so that the fact of tne costs being 25 per cent on the debtis not established. For that matter, the debt might have been $100, and then the cost would haye been 100 per cent. As to the Courts being crowded with business, if the cases are such as contain no doubtful law- joints they will entail very little trouble on the urts, and, if they do -involve doabtiu! law- points, then it is proper the Courts should dis- pose of them. There are subordinate officers to take the accounts between the mortgagor and mortgagee, the. debtor sand the creditor, and they are quite as likely to tase such accounts correctly as the creditor’s attorney. But, inthe longrun, the working of the act will tend to the benefit of the. mortgagee as much as to that of the debtor. Undera sale under a trust-deed, without the intervention of a Court, the creditor sells, and the purchaser, most frequently, himself buys simply the inter- est of the mortgagor.
