Nelson filed abill yesterday agalnst Henry L Sheldon, Charles 11, Mulliken, Henry ¥. Eamen, Bradford Hanocock, snd John T. Nosyes to sct sside a fease. Il states that about tho 1st of May last ‘he leased of C. H. Mulliken, a8 agent, tho premises No, £30 Fitth avenue, with the buffidings, machinery, ete., thereon untll May 1, 1881, at a manthly rental of 8200, 0r $7,200 for the entire term. Ieim- mediately took possession snd made conslder- able impruvemnents, but learncd & shors time seo that Mulliken was nut the owaer of the premises. The title Lo the property in March, 1876, belonged to Samucl L, Brown, and he gave a teust-deed to Henry I, Bheidon to eccure tho payment of $15,000, and swother tn J, T. Noyes to secure $3,500, Becoming cmbarrassed soon after, Drown, in 8¢ptember, 1877, conveyed nearly all bis real estate to 31, F. Eamesand otbers, jn order, a8 is charged, to prevent it from befng distribnted among his creditors when he went futo bankruptey,—a step whichhio contemplated taking at that time. It was about this time that Mabliken obtalued possession of ths premises above mentioned, and leased them to complalne ont. In Febraary, 1878, Brown went into bank- ruptey, and Bradford Hancock was appointed Assleves. Brown schieduled no nssots, and has obtalned o discharge, but hits Asaignee has learn- ed of tha above transfor to Eames, and is taking steps to have it st aside, it baving been made within six montks of the sdjudication. On the 4th of December 1ast complainant was notified by Sheldon that the laase had been s dgned tobim by Mulliken, but he refused to recogalze him ay landlord, and Sheldon tnen be- ean a suit for the rent. e reeovered jude- ment, and complaivant appealed.
