Tlik CHICAGO TRIBURE: BATURDAY. NOVEMBER 1878—1'V I TILE COUX Construing the Roads and Bridges Act. Record of Judgments, New Saits, and Miscella. neons Business, The opinlon in tha case of the City of Galena et al. va, Tho Comumissioners of Highways of the Town of West Galenn was filed yesterday in the Appellate Court, The case was brought here by agreement trom Jo Daviess County, and the only point presented was the construction of the exceptiug cluuse fn See, 84 of the *Act fo regard to rosds and bridzes in ecoun- ties under townsnlp organtzation,! Do proved May 26, 1877, A tax of 83,100 wos Jevied for tho year 1817 in the Town of West Galenn, which Included four words of the clty and other territory, and $1,0105,48 was collected on the property in the city portion. The city demanded that this be vaid to it, as It lind control of the atreets, alleys, ete., and the town Highway Commiasloners also demanded it sbould be pald to them, The Col- lector declined to pay elther until the question was passed on by the Court. The clty then fled s Lill to get tho money, but its bill was dis- nfesea and the money ordered pald to tho High- way Commissioners, See.81 of tho law required that theCommissloners of cach town should ralso Ly tax the necessery amount for maklog and repairing roade, * provided that the tax on the proverty levied for rond purposes, 1,\-ln§ within an incorporated village, town, oreity in which the strecta and alieys are under tho care of the corporation siiall bi paid over to tha Treasurer of such villagy, town, or city.” ‘The statute then went on to prescribe how the tax should bu collected, and Bee, 84 vamml that the tax 80 collected should be pati to the Treasurer of the Commlissloners of "[zhways (* exeept as grovided {n the lirst clause of "Sec, 81 of this Act"') by the Collector a8 fast as the samo s collected, except nx'n:h z?w ver centas shall be llowed for collecting the same, * Sudgo Plensunts, in dectding the case, antd the only question was whether the clause in paren- thesia above quoted excepted trom tho require. ment of puyment to the Trensurer of the Com- nisston :rs o much of the tax mentioned fn the wecond clause of Bee, 81, that 19, **for the mnak. fng and revairing of bridges,” as was collected on property lylng in the city, or only so much of that inentioned 10 the tirst clause, that Is, the tax **for the makiog and repairiug of roads only," as was so collected. The mct of 1874 Lenring the smmne title lhad substan- tially ‘the same provisions as the pres- ent act, thougt drawn up In different phrageology, and the Bupreme Court hnd de- clded on & construclon of that law that the excenting clause thercin did relate to the road and ridge tax, and that so much as was rased on propertvin the city must be paid to the Uity Treasury, and If the clanse was applicablo to corrceponding Sec. 81 of tho act of 1877, it would be declsive of the present ease. T'here wns no eood reason to declare {t_fnapplicable. The decision of the Circuit Court of Jo Daviess County in giviug the tax soraised In the city to the town authorities was erroncous, and would lave to bo reversed nnd the cause re- manded.
