Kantzler and the Board of Educatlon came up again yesterday morning be- fore Judge AMoore. Messrs. Hkinner and Chandler appeared for Turlbut, Messrs. Wood- bridge and Bianke for Kantzler, and Sidney Smith for the Board of Education. Mr. Woodbridge contended that the bill on its face showed no equity. It set up a coutract for the arsignment of a school lease, and then shawed that that school lease provided that no assigiment should bs made without the con- sentof the Board of Education. The Court could see that such a contract could mot be snecdfleally enforced; it was an Indispensable prercquisite to & decrc for specific perform- ance that the defendant was unable to perform, The present bill showed that he had no ability to perform, and could only do 10 by getting the consent of the School Bosra, s body over which he had no control. On the part of the coniplainant It was con- tended tbat, althougl the bill disclosed the fact that the consent of tho Board was a condition precedent to Kantzler’s right to assiga, yet if was necessary for the defendants to set up fn the amawer that tho assignment could not be obtained.
