Tobey akalnst bis partoer, William La Pierce, for adissolution of the firm of Tobey & Picree. Compinlnant says that, on the 20th of March, 1875, he went into partnership with the defendant for the purpose of carrylug on the packing and provision business. Plerce fur- nished as his share the interest he had in the packing-house Nos. 237, 220, 233, and 235 Des- plaincs street, the buililing being situated on Jeaced ground. It was agreed that complatnant should not be responsible for therent of the bullding nor for Plerce’s individual debts, but might at his optlon obtain & half interest fn the Dbuliding and lease. About 2,000 has Leen expended fn Dinprovements on the bullding, for which complalnant is outl- tled to be refmbursed. Plerce has also drawn $2,000 on account of the fmlchtedness on the packing-house, and §5,000 on his own sccount, making §,000 in all, which should be credited to his account.
