Des Moises, Feb. 6.—Ibere have been no new developments in the affairs of B. F. Ailen to. day. Tuo dissatisfaction existing yesterday at his statement is growing m intensitv, but he maintains his reticence m the faco of the do- mand for further explanation. His creditors have very little cause for hoping for anything definite character, and want of detail, is sceupted as eimply 8 “promise to pay,” and ia ua pa: with his former promise to pay dollar for dollar, made when he must have been con- gcions that he could not possibly fulsll it. Noth- ing farther has been gleaned of the character of his assetu that tends to encourage anybody. The yea! catate item of bis elatement, amounting to §1,204,615, is seid by good acthority ‘to be worth, if put on the market, nor, not to exceed $100,009, s large portion of which consista of wild laods, which he has val- ued at 825 per acre. It is claimea, also, that his tiuto to the property is not ciear, and that ho holds st cimply in trast. On the ctber band, an abatract-man saya that his real estate in this city alove is worth $1,000,000, a!l of which is incambered, however, and to what extent no- ‘body kaows. A THE DES MOINES ATMOSPHERE. A stranger coming to this city at present is pecniisrly impressed. 1f he chances to stop gt one hotel, and in his walks visits another, he ‘will be likely to meet ® difference of opinion. On one of the leading hotels Mr. Alien has a mortgage of nearly €100,000. The atmosphere taereaponts is laden with praiges of Mr. Allen ead expressions of confideuce in him. At another firet-class house the gcene changes, and nothing but cuvses are heard. A good deal of interest centres in the $900,009 mortgage of Stephuns & Blenne: basse:t, of New York, which covers, if anything, bis entire real estate, Allen said yesterday that if the clam was sustained * his surplus showing would vanish at once, in which event no one bere would get anything. ‘Mr. Allen has this mortgage in bis possession, and, wluleit iss matter of record here, it is murked “satisfied” at his instance, ss the senior partner of Allen, Stephens & Co. Teley, of the Executive Committee, pregentod.an informal report, to the effect that the Committee had organized, and appointets sub-committee to report » change in the rules, and to secure another place for the meetings of the Aszociation. Mesars. Richard Waterman, Arthur J. Caton, G. W. Pretzinger, I. W. Perce, and Charles ¥. Butler, wera recommended for membership by the Committeo on Admission. + A wotion was made to recommit the names to the Committee. ‘The Ckair ruled this motion ont of order, and, in order to obtain the sense of the Association as to the construction of the by-law on the subject of balloting for members—whetber tho Associa- tion could postpone action upon the admission of candidates for membership after the names have been presented and Jaid over from one meeting to another—an appeal was talen, aud the decis- ion of the Chair was not suxtained. The names were recommitted to tho Committee on Admis- gion. we ois CONSOLIDATING THE SUPREME COURT. Mr. Jewett, of the Judiciary Committee, re- ported that a bill for the consolidation oi tho Supreme Court terms bad been introduced in the State Legislature; that the Committee hed agreed to recommend the amendment of the statutes so that nisi prius courts may bave the power, when the evidence warrants such a course, to order a nonsuit; that the only practicable way to diminish tho pressure of busi- ness upon the courts, was to MARE LITIGATION EXPENSIVE to the parties instituting ft. Mr. Jewett, In sup- port of this Iatter recommendation, chatacter- ized htigation as a luxury which litigants should pay for.” They should be compelled to advance a portion of the jurors’ tees, and the courts should hare the power to order the payment of attorney's fees. NONSUITS. Tho smendment ‘to Sec. 50 of Chap. 110, Re- yiged Statutes, proposed by Mr. Jewett, is as follows: ‘Bro, 50, Im all trials at law ft shall be the right of the defendant upon the close of the plaintiff's case to move the Court for a judgment of nonsuit aguinst the plaintiff, and the Court shall grant such motion and enter judgment accordingly whenever the evidence shall be insufficient to warrant a verdict in favor of the plaintiff. Appeals and writs of error may be pros- ecuted from judgments so enterad as in other cases; but every person desirous of suffering s nonauit on trial shall be Larred therefrom, unless he do 60 before the jary retire from the bar. Judge Lawrence thought the language cf the bill too broad, as it substantially pit the Circuit Judge in the place of the jury indetermining the weight of the ovidence. : ‘Mr. Jewot! said tae bill only contemplated tho allowance of nonsuit when the plaintiff failed to make out a caso. ‘Judge Dickey thought the bill was opposed to common law. Ile suggested that it be changed so that the evidence eball “ support” instead of “warrant” a verdict. -Such 8 motion was | made and adopted, and Judge Dickey moved to | add this clause: + And thst hereafter in civil actions no exceptions shall be allowed to the judgmeuts of Circait Courts re- fusing to graut new triais, aud that euch judgments hereafter rendered shall not be ussigned for error, Judge Bradwell believed that the attachment of this clause would jeopardize the entire bill in the Legislature. It would be desirable to incor- porate it in another bill, ‘The latter suggestion was agroed to, and Judge Dickey’s addition was temporarily withdrawn. Mr. McCoy moved the addition of a section giving Judges the right to give ORAL INSTRUCTIONS to juries as to the evidence and the law, Tebe- lieved this would prevent many appeals. It was agree’ to put this in a separate bill ‘A motzpn Was then adopted requesting Judge Bradwell to urge tie passage of the bill as re- ported from the Judiciary Committee, with the sabstitution of Pee "for “warrant.” | ‘Mr. Cooper moved that the preamble and reso- lution, given above, be referred to the Commit- tee on Amendment of tho Laws, with instruo- tions to repoct a bill in accordance therewith, ‘Mr. Moran thought the two rgpanitions had better be repoited, as ho believed that the clause requiring the advance ‘payment of jury fees would defeat the entire bill. Mr. Dexter was oppused to both the measures contemplated in the resolution, and quoted Backls to prove that litigation was not a luxury, but a necessity. Access to the courte should be made easy to all citizens. > | Mr. Horton said that the war- in the Legis- lature was “cheap justice,” and he did not be- lieve the biil would pase. Gen. Stiles said this was no reason why the bills should not be urged. He opposed both propositions on other grounds, believing that justice, like salvation, should be free. Mr. Withrow thougbt that Jitigation was the result, not so much of misfor:ane as of ‘* pure cusseduess” on the part of the people. If they adopted an expcusive mode of litigation, let them pay the expense. ‘The preamble and resolution wore referred to the Committee on Amendment of the. The County Board Has Done Nothing. The Board of Health held a special meeting yesterday to consider what measures might bo taken to confine the small-poxto the County Poor- ‘House and Asylum, where, as stated in yesterday's Tars0nz, it bas broken out to an alarming ex- tent and with virulence, and protect the city from a visitation of the odious disease. Mayor Colvin was present by invitation. Dr. Hahn took the chair. + DE. MILLER suid that the day before he bad visited the Poor- House upon the report of the presence of the disease there, to seo if there was any danger of contagion to tho city. He had founda school- room in which were contamed fourteen smull- pox patients, mostly women and children. In another building wero ten men afilicted with the same disease. They were without proper methods of treatment, particularly in respect to preventing a spread of tho disease ; woll and sick were huddied to- gethor, and there was uo way at the Poor-House, in its crowded condition, to keep them separated. People coming there from the city were exireme- ly liable to bring it ty the city. Paupers tilled with frigut at the appearance of the demon might fee from the Poor-Hcuse in numbers, and tie city consequen'ly might become seriously infected. It was proper to take the most thorough precautions. ‘Dr. Hahn asked if tho disease had not exiated thore for some timo. Dr. Miller replied that the first case was dis- covered Jan. 19, and the present cases were the first crop ; the next would be worse. There was po means ac the Poor-House by which the con- -yalesvents and well people could be kept from the alllicted. VACCINATION, Dr. Moore asked if oiforta were being made to vaccinate the inmates. ‘Dr. Miller: said that Drs. Lawless and Oun- ningham had vaccinated quite a number. r. Moore asked what tho Doctor would sug- st. : Bent. Miller replied that he had been thinkiag that parhaps at yas best to ‘ESTABLISH A GOVERNMENT. * He had also thought some of calling the Coun- ty Boara’s attention to the state of affairs. ‘Yna Chair thought that Board, probably, was already informed. But the health of tthe city should not be hazarded by its slow sctidn. He thgayht the county officials had beou largely ‘responsible for the prevalence of the disease, ‘Dr. Miller thought the Conncil would :eadily grant them the right to establish a quarantine. Mayor Colvin thought thero would be no doubt of it, as the necessity really demanded i:. ‘Tue Clerk here read ‘tho law governing the Board of Health in such cases. Dr. Miller said ho believed the best thing to do was to establish quarantine boundaries at ouce, aud notify the Couaty Board afterwards. The bey suthoritics of Jefferson would co-operate, and’ GUARDS SHOULD BE APPOINTED at the toll-gate, and on tho Whisky Point road, to prevent paupers from fleeing from the place infected aad coming into the city. Dr. Hahn thought the Council should be in- formed of the necessities at once, and have it call s meeting on the matter. Mayor Colvin said that, as the measure did not ioyolve ap expenditure of money, he thought the consent of the Council was uot reqwrod. ‘Dr. Miller thonght, under the circumstances, the county wagon spould not be allowed to come into the city, ‘Dr. Hahn said he believed that the ordinanco read referred to foreign emigration, and that, a8 the present emergency only involved their own population, he thought the Council had no busi- ness in the matter. Dr. Miller moved: that the Secretary be in- structed to direct A COMMUNICATION 7O THE BOARD OF COUNTY COMMISSIONERS, calling their attention to the condition of things at the Poor-Honse, and telling them that the county wagon will not be ailowed to enter the city autil the digoase has abated. * ‘Mr. Mdore thought a committee ahould be ap- pointed to wait upon the Board. ‘The Mayor thought tt was a very important matter, and thst perbaps it should be introduced to the county offictals by a committee. ‘Mr. Moore moved to this effect, and the Mayor and Dr. Miller were appointed. ‘The Mayor said that something should be done on tho quarantine question. ‘Dr. Miller said they might take action at once, and present it to the Council at the next meet- Be. Hahn gaid the Board hed takep a good deal of pride in its efficiency in keeping the city almost éutirely free from small-pox during the past year. It would not do to relax their efforts now, and be favored an IMMEDIATE QUARANTINE. Dr. Miller moved that s quarantine be declared as far as the County Poor-Hoase aud.Asylum are concerned; to place men at proper localities to prevent people going back and forth without the consent of the Board of Health, and to ask the approval of this action by the Common Council. ‘Mr. Moore thought the motion was at moat too sweeping. The territory was 80 large that it would be difficalt to guard it Dr. Hahn doubted whether they had a right to place men ia the neighborhood of the infected county buildings. On referring to the law, it was found that the Board, in cases of quarantine, had aright to go 15 miles beyond the city. Mayor Colvin thought the motion was none too sweeping, and that it could be enforced with proper efforts. It would no doubt cause incon- yentence to the usual travel, out the, health of the city was at stake, aud the moat stringent measures were allowablo to save us from a terri- Le epidemic. Dr. Schloetzer suggested that the County Agent be asked not to send any more people to the Poor-Houss. Dr. Miller’s motion was carried. Mr. Moore moved that the matter be brought to the attention of the Common Council Mon- day night, and that tho Committee appointed wait on the County Board at ite meeting Monday afternoon, ¥: ‘The motion was carried. e Dr. Miller then alluded to his visit at the Poor- House, describing some of the .
