The trint of Sorgt, Michnol O'Connor, of tho Armory Police Station, on the doublo chargos of appearing habitually out of uniform, and of having beon in an Intoxicated condition Inst Thursday evening, tov place in tho ofilco of the Board of Polico yeatorday afternoon. A large crowd witnessed the proceodings, many of the city officials being among the audionco. Com- miasionors Shoridan, Reno, and Klokke woro presont, tho formor presiding. ‘The charge of APPEARING OUT OF UNIFORIC was first taken up, and to this accusation Bergt, O'Connor pleaded guilty, He was asked to mako atatomont, which bo did, substantially as fol- lows: Ho knew that be had beon ordered to wear bis uniform, but wont without it that he might the botter look after his men; nevertheless, ho did not believe that there was any excuse for it; tho thing was customary among Police Sorgeants for yoars ; Capt. Buckloy had told him ropeatedly to appear in uniform ; other Sergeanta wero somo- times in the habit of going in citizous' clothes when watching their mon on duty, @. In reply to Commissioner Sheridan, Capt. THE VERDIOT. Aftor = dolay of about fifteen minutes, the Prosident of the Board called for Bergt, O'Con- nor, who appeared before the railing. Mr. Sheridan read him a lecture onthe iniquity of appeating out of uniform, and said that he should attend to the matter forthwith. Unless superior officers obeyed the rules of the service they could not oxpect tha men to bo roprimand- ed. A petition asking for a writ of habeas corpus was filed yesterday in the United States Circuit Court by the bankrupt firm of Salkey & Gerson, It will be romemberod that about two weeks ago Judge Blodgett committed those bankrupta to fail for refusing to give in o satisfactory manner an account of about $20,000 of thoir proporty which it appeared bad disappeared from their store betweon January and October, 1973, and immodiately preceding their bankruptcy. ‘Tho potition sets out at lougth tho proceed- Inga in bankruptcy againat thot, tho ordera for thelr examination and committal, and a portion of thoir testimony taken before Register Hib- bard. It appears that Gorgon was asked to give a full account of bis property, and the diaposi- tion he had mado of it, and replied that he could not farthor than ho had dono. Salkoy, in reply too similar question, said he could not add any- thing to Gerson'sstatoment, except that tuo Mar- shal had taken it, The petition thon rtatos that they wore imprisoned, not becauno thoy had failed to ‘give no statement, nor becauso they had falled to give any account, but because they had failed to givo an sccount satisfactory to tho Judge. For this they thought thoy could not be legally imprisoned, and asked that the cause be raviewod by Judgo Drammond. Ashort stgument was had yosterday morning before Judge Drummond, counecl for tho poti- tioners insixting that the Crreuit Court could re- yiew all ordera and decisions of the District Court, while the counsel for the creditors insist- ed that each court was tho sole arbiter of cun- tempts beforo it, and that from its dociviou no appoal would lie. ; : Judge Drummond eaid that tho Circuit Court had power to roview tho orders and docisions of tho District Court, and ho should grant tho writ of habeas corpus, even though the petition did not show but that, if their causo was all con- tained in {t, the debtors would, if no other evi- denco was offered, bo nocessarily romanded to jail, but thera might bo somo furthor facta not ombraced in tho petition. Tho writ was issued, and in the afternoon Balxey and Gerson gavo bail in the sum of $6,000 each until the 8th of Februsry, when the argument of tho case will bo had. : THE TRADENs’ INSURANCE COMPANY, Judge Blodgott decided yesterday the question of tho tax on the persona! property aud capital stock of tho ‘l'radere’ Insurauce Company. Lo rantod a tomporary injunction against tho col- lection of the tax on the capital stuck, and beld that tho tax on tho capital stock nod that on the ersunal property could and ehould be appor- Honed io proportion to the respective amounts, and that the Collector should return the .chairs mhen the tax on the personal property was paid. ‘The docieion on the cnypital stuck tax will do- pond on the decision of acasy now under con- sideration by Judgea Drummond and Blodzeit. ‘A CONFLDING CLIENT AND CRAFTY ATTORNEY. ‘A bill was filed yestorday in the Superior Court by John F. Coffman apatial George Beovillo, J. I Bickerdtke, J. M. Scoville, and Michael Traver, in which complainant shows his own crodulity and confidiug nature in a very marked maunor, sa well aa the craftinoss of bis attorney, Qoorge Reoville. According to Coffman's story Goorge Scoville, in December, 1872, sold to Bick erdike the N. E. 3 of See. 18, 38, 12 for €22,000. Bickerdike, however, did not want to take the title in his own name, and, aided by Scoville, who was at tho time attorney for both parties, persuaded complainant to take the lan merely as truatoo, make part of tho payment cash, aud give his —_notos forthe remainder, Coffman did so, Biekerdiko making part of the cash payment, and both of the parties thon giving notes for the valance. Coffman subsequently ascertained, before tho whole transaction wan fluished, that thero was a prisr incumbrance for $9,000 on tho and, of which ho notified Scoville, Whereupon the Iot- ter promised vigorously that tho mortgage should be paid, sa that it should not bo in auy-.| body's way. Not having any dosire to euffer such a injury to hia crodit, Coffman, under protout, paidtwo notes, A third fell duo in September last, aud, not boing paid, tho trust-deed was foreclosed, and at tho salo Gcorgo Scoville hid in the property for him- self. The result of all these procecdings ig as epitomized in tho bill, that Goorgo Scovillo has roceived $7,697 for the land, in cash, haa notes for $16,000 more, and still has tho title to the roperty, Complainant “well hoped that enid coville would have beon satisfied with obtain- ing aain sum of $7,697 ond his land back, but now as ho not satisfied with ithe has hrought suit for the Liance duo” on one of the notes, and is proceoding to collect it. Me also proposes to make the remaining €16,000 ont of complain- ant; and yot ho has not paid or released tho in- eumbrance of $9,000. A protty woll-defiued doubt has cronued the mind of Mr, Coffmaun how affairs can be in their present condition and yet be right, aud he ia in Borious doubt a8 to tho advisability of acting og friend or trustoo again at hiv attorneys’ request. Coffman charges, in conclusion, tliat George Beoville has boon guilty of unjust, mequit- ablo, and unprofecsional conduct, ond bas basoly violated bis trust as. attorney in ‘Sttompting = to ~— make him (complainant) chargeable for land in which ho had no interest, aud aska that Svovillo may be decroed to pay back avy aums he bag receivod from him, and to surrender any notes ho may bavo, aud also that an injunction may be issued toprovent him from prouccuting any suite on auch notes. PARTNERSINP DIFFICULTIES, Noderick Clark tiled a bill yesterday agaiuet Laura Stark and W. K, Nixon, oxecutrix aud ox- ecutor of tho will of J. L. Stark, asking for an account. Clark says that he, together with two others, were engaged under the firm namo of Pierce, Clark & Bharp, in building tho Chicago Poulin & Southwestorn Hailrond. An agreoment was mado with Mr. Stark, it a charged, by which he was to receive ono-quarter of tha not profite of tho contract if he would give his legal #ervicesin drawing papers and obtaining the right-of-way for the road. W. B. Ogdon was to hava like abare if ho also aldod in obtaining right-of-way, and assisting in other ways, but ho utterly refused to have anything to do with tho scheme. In May, 1871, Pierce, Glark & Hharp, at Btark’a advice, sold their eoutract to one Ralph Plumb on condition that the latter should: ay $30,000 in bis own notes, 20,000 ju stock of the Railroad, aud assume debts of the firm to the amount of &60,000, and give hia in- dividual bond for the faithful porformanco of the contract.
