Seam- mon, woa taken up yostordny morning bofore Reglstet Hibbard, Tho question was to ascor- taln whother thoamendment o the orlginal poti- tion, stating that the United Statos Mortgago ' Company constituted one-fourth in number and one-third in amount of all Mr. Bcammon's cred- {tors, and which amendmont was sworn to by Mr, Sansomo in good faith should stand. At 10 o'clock the Rogiater, Mr, Dexter on behalf of tho Mortgage Company, Judge Trumbull on bobalt of Mr. Heammon, Mr. Sansomo, snd 8 phonographor, nescmbled in the Unitod States Circuit Court room, whero Mr, Scammon soon sftor sppeared, and the inovitablo reporters. Prior to the commencomant of tho oxamina~ tion Mr. Doxter objected to the examiuntion for tho roason that, undor the Inw, whore n potition is fled on information and boliof stnting that tho potitioner constitutes one-fourth in mumbor and ono-third in amount, that the provisions of tho Jaw mako it mandatory upon tho allogod bank- rupt to filo hils list of conditions, and tbat any such procoeding before filing such list was con- trary to tho provisions of tho law, irrogular, and boyond tho authority of the Court, Mr. Sausomo was then oxamined hy Jndgo Trumbull, Tho witncsa safd that prior to October, 1872, he Dbad enter- tainod n snsplcion that Alr, Beammon wag ombarrassod whon My, Forsyth camo to him to offoct a lonn about which he scomod oxtremely anxious, and witness subsequiontly loarned that tho loan was for Scammon on his property. Ho lind made & number of inquiries about Mr. Seam- mon’s condition, aud had come to the conclusion that ho was insolvent, Ilo had hoard that an indofinitoamount of Seammon's unpald paper wan known of by brokers, In October, 1373, ho lnd rocoived a lottor from Mr. Scammon stating that hio conld not mect the scorutug iutercst, aud should bo for the firut time in thirty-oight yonrs oblized to nek an oxteusion, This “wns granted Ly the Company, but aftor & mouth or mora wit- neas called on him, sud in a talk over the matter iuformed Dbim tuat the Company did not dogtre to preas the mattar if ha would give addi- tional security for the accruing intorest. This Mr. Scamupion declined to do on tho ground that tho Mutual Seenrity Insurauco Company had rocovored o judgment againat him, and that any asuignment -of lus proporty wozld bo useloss, ‘Witness also learnod that Mr, Scammon was not paying interost on the large lonns, amounting to about £800,000, in his own nane or with some ono oles, o tho Counecticut Mutual Insurance CUompnny, and therefore concludod that ho wos uuquestionably in au embarrassed condition, Moreover, Mr. Scammon himself bnd stated gucli to bo tho fact, but thought ho would gob through. There is no longer any doubt that the Natfonal Boord comjanics are repenting in sackeloth and ashes their hasty oetion in withdrawing from this city. They aro moroly waiting to got a good excuse to como back without stultifying them- golves, and the appointment of Shaler would give them tho coveted chance. These companies, when thay firat withdrew from this city, thonght they wouid throw the entire city into confusion, destroy its credit, and thon dictato terme to their liearts' content.
