While tho posseasion of an Auditor's cortifi- cato is not an absoluts guaranteo that a company is solyont, atill a compauy which is unablo to procuro ono is not ns safo to insuro in as the other, The compnnies last named have failed o comply with the laws of Iilinois, nud, .hy issuing noficies in_ Chicngo, nro guilty of & violation of the 'statuto. Tho Attornoy-General is looking into tho mnttor, and, if tho proper ovidenco can’ bo obtained, tho ngents will bo prosecuted, These ngonts, or brokors as they ¢all thomselvos, claim to act ns tho egent of the insurcd, tho premiwn money being sont (o the homo oflico, and the 'mllchu written there and forwarded by mail. Ithis is the way tho **wild-cat” companics are doing business, aud it js doubtful if the Inw can ronch them. If not, the only way to drivo them out is to let their policies alone. Their rates may bo very low, but, in eate of anything moro than an ordinary loss,—nud oven in'tha cano it iy donbtrul,—thio amount of the premiuin would not bo received by tho policy-bolddr. In May, 1867, John 1L Irwin, one of tho com= pinfuants fu tho prosont cawo, obtalued a patent for’ A TUBULAR LANTERN, A sndl in 1808, 1869, and 1870, took out other patonts for improvements or modificas tions of this original - lautorn, As i well known, vegolablo or animal oils contain a varying proportion of oxygon, which enablos thom to burn with greater onso than minoral or hydrocarbon olls, a8 korosond, which aro dostltuts of any oxygon. To obvinte this dificulty, MONE OXYAEN ‘must be supplied to tho Iatter class of combuatl: bles to insuro that nececessary combination of oxygen and earbon which is callod combuation, Irwiu theroforo altemptod to obtaln this reenlt by carrying & supply of air down to the baso of tho barner of n lamp or gas-jot, instend of allowing the flamoe to bo supplied, by such wir ns was in immediste contiguity to tho flame., In. his first patont : he plncod a funnel or bell over tho flame, adjuated at such & uulp{ht that the products of combus: tion, consistivg of carbonio' acid' and vapor, should have a chauce to escapo instend of boing drawn into the fuanal, This boll wad thoen ot~ tached fo n long tuba, which waa enrried down to the base of tho burner, and supplied ‘it with air bolow tho cono. In an ordinary lamp, ng will bosoon on ox- amination, the air requisite to sustain tho flame is supplied through s porforated plato bolow tho cong, whith also sorves to sustain'tho chimney, the latter aoting a8 n flug to crento blast, and al tho samo timio sorving to protect tho flamo from outsido dralts. Irwin only allowed tho flamo to be supplied from tho alr ‘which camo througlt tho tubo from tho funncl, and his_ the- ory was that tho heated air’ from tho flame, im- pinging on the surronnding cold air, drovo tho latter through the tubes, TNE ESSENTIAL POINTS of bis invontion ‘wore, as ho claims, a bell or fannol placed at sioh a distanco abovo the flamo as to roceivo n volama of pure iir, a tube to pasa this to the baso of tho flanio, without avy escape, aud any kind of ordivary burnor combined witht the tubio and boll, : But this Iomp hed no chimuoy, and thg flame was doflected by nny surrounding cnrrenta of air, o obriato this objection wan tho purposa of 1114 SECOND INVENTION, N whoroin lio 2dds to]tho foregoing patent.a globa which ho' tormed o protactor.. In' ordef that thoro should ben supply of . fresh air, through tho funuel, & space was left botwoon the top of the globo and tho funnol, and a parforated plato was placed at tho Uneo, on which tho globo rested, which also allowed tho paesago of air. Theso wora tho ossoutial polnta of tho inbular. lamp or lantern involving this priuciple, as the,iu- voutor elainied ; tho supply of nir to the flamo of & lamp, or gn-s-]eb, through a tubs or funnel, by a blnst, tho blast being creatod by the Loated afrof tho lamp, instend of dopending first on tho inort maes of alr fmmodiately surrounding tho flamo, a8 1n an ordinary lamp, or socond, through any blagt furnished by s chimnoy. By threo subsequont, iuventions Trwin added dovices for supporting tho globa in place by a spriug, and improvemonts in the shapo of the cono and jacket, and their adjustmont to tho Iamp,—nouo of them, howover, varying the prin- ciplo of tho first two invontious in tho mothod of supplying a blest of air, Irwin claims that o hea mndo theso Ianterns for somo yeara! and that o Invgo number of parties have paid hima roynlty for licenses to manufacturo thom, TIIE DEFENDANTS, Dane, Westluke' & Covert, alarge firm in this city ;engnged in tho manufactare of lamps and lantorns in this city, Lowcver, made a lantorn similar to complainant’s, and rwin accordingly brought suit for infringemont of .patont. To this the defendant ploadad that Irwin was not the first inventor.of the dovigo, but that it had boen kunowa for filty years in France, Holland, and ILngland, and hera comes in ONE OF THF GURIOUS POINTS OF THE CASE. It sppenrs that iu 1826 P, Tespnz, a Fronch- wman, noticed that smoko and. vapor were given oft from the combustion of oil or gas which often bilnckened tho ceilings of roomns or injured tho goods in p atore, and attempted to find somo meaus of gotting rid of theso noxious products of combustion; either by carrying them out of tho apartmont, or burning them in the flame whoneo thoy originated. ~'To accomplish this, Lo placed a globo ovor the flame and o short distance abovo it, partly to coudense the yapors, aud partly to carry thom down by two tubes, and introduco thom jn tho flame to be " moro thoroughly decomposed. 'I'espnz also_designed in some of hin devices to condonso and precipi- tato theso products of combustion in water, to carry them in tubos out to the open air, or to condsuse the vapor and precipitate wolid particles on a surface of cold metal. In short, Teapaz's invention wag, as ho states in his spocifieations, ** s sinoke- contuming, vaporizing, condonsing apparatus, sunilable to condense tho vapor produced by thoe comubustion of gas or oil, &e." A year altor, and {n 1827, Mesers, Orry, Norry, and Do Cormeilla patented nn invention baving o similar objact in, view to that of Tespaz, aud which they called o FUMI-COMBURATEUR," or maching for destroying or consuming smoke, Thoy employed for thit purposo & bell aver the flamo to receive tho products of combustion, and o tubo to cmry them down to tho flame, into which they wero emptiod year the top or hottest part of the flame. The puro air was supplied ontirely from tho bottom, ay was clalmed. arg alter, two Frenchmon, ‘Martin fotlowing tho. stops of tholr pro- decessiors, obtsined & putout fora aimilardevico, llll\’illt(l\flil lar objoct, tho aifforeuco beiug that this Inst invontion was spocially employad to utilizo tho wasta gus that csonpos whon too groat n prossure is cmployed, go that it is not all burned, and that air wos mixod with this re- turned gag bofore it was driven into the ume, TILE ENOLISIT now took up tho same ides, and in 1817 John Braithwaito patouted an invention for ‘recoiv- ing tho smoke aua othor noxious oxhalations sud earrying thom back into. the flame." In this patent tho smoko was discharged on the ine sldde of tho flame on an argand burner, pure air being supplied from tho outelde. Tho modol strikingly resombles somo of the complainnnt's deviees.
