THE CHICAGO DAILY TRIBUNE UESDAY, DECEMBER 23, 1873 WASHINGTON. Supreme Court Opinions in the Chicago Bankrupt In- surance COases, Oleims on Policies Cannot Affect the Payment of Stock Notes, An Important Decision under the Bankrupt Law. A Judgment Obtained Prior to Proceed- ings Held to Be a Good Lien. dratifying Report of the Govern= ment Directors of the Union Pacific Railroad. &pecial Dispatch to Tho Chtcago Tribune. THE CIIOAGO DANKRUPT INSURANCE CABES, ‘Wasmnoroy, Dec. 22.—In the Unitod Statos Bupromo Court, this morning, opinions wore read in the Chieago bankrupt insurance cascs by Mr. Justico Miller. Tho principal opinion was in Sawyor vs. Hong, Assigneoof tho Lum- bormen’s Insuranco Company. Sawyer had sub- seribod for $5,000 of tho original stock, and givon his check for tho full amount, Ho then gave his noto at 7 por cont intorest for &4,500, and took boek tho monoy as somuch of tho oheck., As botweon the partios this was no doubt a loan; but as to tho public, tho Court, held it wag o eredit for so much ou the stockasa stock note. So that Sawyer could not sot'up a bona fido claim against the Company as a got-off agninst tho noto, but must pay tho full amount of the nolo to thie Assiguoo, and thon take his dividond for his debt agninst the Company with tho othier creditors, In tho samo way was do- cided tho cases of Jaoper ve, Vocke, and Margor v, Vocke, Assigneo of tho Germania Insnr- once Company of Chicago, both involving tho same priveiplos, Soveral other cases, involv- ing tho same questions, including Jonathan Y. Scammon vs. the Asesignoo of the Mutual Se- carity Insuranco Company, are still undecided, but, of courso, will be coutrolled by those do- cisions when rosched, oll finding - their origin in tho great Chicago firo of October, 1871, IMPORTANT BANKRUPT DECISION, In tho casoof Wilson vs. 'U'he City Bank of St. Poul, Minn., avery important docision was mada by Mr. Justico Miller, " which the Court, in his opinion, say3is not in accordanco with the de- oisions of most of tho_District Judges, Tho caso was_ tnia: Vanderhoof ~ Brothors becamo embarrassed and unable to pay their debts, Tho bank suod them on o noto proviously given, took a judgment by de- fault, took out an exceution, nud lovied on their stock of goods. At the timo the action wes ‘brought both tho bank and its dobtors know they wero ingolvent, and had committed un act of baukruptcy. Aftor tho judgment snd lovy another creditor, Wilson, commenced proceod-. ingsin baukruptey against tho samo dobtors, aud they wore adjudged baukrupts bofore the #amo, and tho Assigneo claimed tho goods thus lovied upon, insisting that tho dobtors, in allow- ing judgment to go ogoinst thom by do- fault, wero guilly of & fraud on tho ~ Bankrupt = law, and of proferring thio bank us creditor. On the trial the following questions arose, in relation to which the Judges wero opposed in_opinion: First, whether or not an utent on the, part of eaid debtors (Van- derhoof Bros.) to 8uffer their property to Lo taloou on legal process—to wit: the said execn- ticn—vwith intont to give a preferonco to said baak; cr with infont thoraby to defoat or dolay chio operation of tho Bankrupt net, can b infor- red frem tho foregoiug factss Second, whothior, nedor enid faois, the vaid bank, in obtaining spid judgment and making eaid lovy, bad roasonablo ciuso b belieye that o fraud on tle Bankrupt ace was intended. 'Whivd, whother, under said facts, the bunk obtaincd, by tho levy of its oxo- cution, n valid lien on tho snid goods ns ngaiuat tho Assigneo in Dankruptoy. ‘'he Supremo Court ankwers the two flrst querics in the nega- tive, and tho third ju tho aflicmative, and, in an claborate opinion, hiolds ihut tho debtors were under no moral or legal obligation to dofena tha uction brought by tho bLouk, and yoro bligation to go 'into voluu ruptcy lo provent tho bunk from pgaining a preferonce over tho othor ereditors, aud thet tho bank was guilty of no olation’or fraud upon_tho Bankrapt ~law in bringing the action and obtaining tho judgmont, and that, baviug obtained the judgment fairly, thoy Lud secured a valid Hen on the goods takon in ésocution, with which tho Assignos could not intorfore, and was only ontitled Lo e surplus after paying the bank debt, ‘L'his sottles an im- portant” question which hos long vosed tho Courts and tho Bar, CONDITION OF TIE UNION PACIFIO RATLWAY. Thoy say that tho condition of tho roud iu vastly improved sinco tho lost annual exumination, nud spouk very oncouragingly of its future \)rnspccls. They assert that tho rond can bo mnde to pay $12,000,000 per annum wich 1o oxortion boyond roasonably good managos ment. Caleulating operating oxpenses nt 56 por cent, they estimato that this will pay intercst on the tirst mortgage incomo and Governmont sub- eidy bouds, hosides b per cont of not earning to the Governmont, and leave $700,000 for divi- dends on slock.
