Judgo Rogers was accuplod yesterday in hear- Ing the cano of Philip Lolir against Jobn B, Wil son, tho Prairie State Loan & Irust Company, snd Hendorson & Swith, contractors. Lolr cluims that Lo was injured by a falling derrick in front of tho building occupied by the Prairio Btato Savings Compnuy, while Lio was riding in o earringo or haok on South Desplaines stroot in front of tho building, and that Lo has beon dis- abled ovor sluce in consoquonce thoroof. Wit- son is o contractor, who took the contract for the mason work, and thon sub-lot tho stono- soiting to Hondorson and Sims. The Prairio Btato Compauy claim that thoy aro not responsl- ble for tho damage dono, as they hnd no control of the dorrick, tho whole work for which a dor- rick was neoded having been given to Wilson. Wilkon thinks he ehould not be held rosponsi- blo, as the dorrick was used by Honderson and Sinws, and Hendorson, Sims not being in court, aflirms that tho dorrick was not in use at tho timo the nccidont occurred, but that it was caused by a person riding on an omnibus, who pulled one of the guys which held the dorrick upright, and thas caused it to fall. In tho third soction it is provided, all plages whorein intoxicating liquors are sold in viola- tion of thisact shil be taken, held, and declarod tobo common nuisunces, and all such places shnil be shut and nbated, on tha couviction of tho keapor thercof. Tho penaltics imposed by that scction are for the violation of either section, and it is not in- dispensablo o party should be’ gailty of & viola- t1on of both befora ho can be subjected to the forfeiturcs enumorated, This is the obvious meaning of the words used, and is tho construc- tion given to tho samo language in the statuto of Ohio on tho enmo subject, in Miller v, The State (3 Ohio, 475). Our statute, in many re- spocts, is o substantial, and in othor parts o litoral, tranwcript of 'tho Ohio law, aud it I8 o rule that, whon tho Logis- laturo adopts substantinlly the statuto of anoth- or Stato, it i preswued to sdopt aluo the construction previously given it by the Courts of that State, unloss such _construction is incon- sistent with tho epirit and policy of our Inws, (Riggs ot al. v, Wilion ot al,, 18 TIl., Rep. 16; Campbelly, Qunlin, 3 Szam., 288,) It 15 urged, tho clauso of tho thifd section, which declires all places whore intoxicating liquors aro sold in violation of thisnct to bo comumon nuixances, and shall be shut up_and ubuted, autbotizes' the destiuction of privato property, aud, therofore, contravenos constitu- tional lnw, The construction of this seotion is not in- volved, direcily, in the decision of this cago. Counsol, howaver, is in orror in supposing it authorizes the summary destruction of private property.
