Patent Oages---In Bankruptoy---Bills in Chancery---New Suits, THE LAMAR INSURANOE COMPANY. Samuel H. Melvin, of Springflold, A. 0. Van- dowuter, of Pans, Jobn Heek, of Lookport, and Judson M. W. Jones, of Chicogo, in their bill yestorday filod in tho Buperior Court, show that in tho suit in that Court instituted by Edwin Burnbham and Edwin R. Burnham, sgainat tho Luamar Insuranco Company, Leonard Swott, Wm. 1. W. Cushinay, Tsanc N. Hardin, Wm. K. Ackor- mau, Gurdon 8. Hibbard, Paul Cornoll, Laban 8, Major, Loroy Church, Chas, B. Farwell, and Van H. Higging, on tho 23d day of Octobor, 1671, set- ting up that suid complainants, at the Juno torm, 1872, obtained cortain judgments sgalnst snid Company, ote, and praying for tho sppointzent of & Rocelver, tho bill was orderod taken as confossed as ngninst tho Tamar Company, but not against snid Bwatt and Higgins, or cither of thom, nor wore sny efforts mado to briug the other dofondants Into court, 8o faras appears from tho rocords, and aftorwards tho bill was smended by making the People’s Insuranco Company of San Fran- slsco o dofondant, as dobtors to the Lamar in the sum of 8170,000 for reinsurances ; and on tho 28d of Novembor, 1872, on the motion of com- ploinonts, n decreo was entered appointing Goorgoe Chandler Receiver, who duly made his report, which has boen duly published in Tur Inisuxe. The complainants dip deeply into the history of the Company down to the timo that it sus- ponded, in the spring of 1871, when its sub- seribod oapital was $2,200,000,aud its losses not ox- traordinary ; and charges that its embarrassmonts waro largely duo to the woll-known ngreoment giving Cushman & Hardin 650 shares, with 20 por cont paid thereon, asa promium for thoir subscribing for 5,600 shares, ropresenting 8550,- 000, on which they patd $110,000, and on_which slinrestho complainantsinsist Cushman & Hardin aro linble for nssessment. On Cushman & Hardin' subscribing tho S550,« 000, it is furthor alloged, tho Compnuy mado ot tho' cortificatea for tho 650 shares, with 20 por cent paid up, and honded thom to Cusbman & Hardin nunlgi“ and tho $110,000 paid in by Cushman & Hardin on their £550,000 subscrip- tion was taken back by them, in small amounts, from timo to timo, botweon Beptomber, 1870, and oy, 1871, and the stock cortificatos turned back to " tho Gomfinny snd canceled, as though the amount they reprosented had never formod tho capital stock of the Company, thus seriously reducing tho capital stoclk, Losides withdrawing o lazrgo sum of monoy, oithor in cash or cash so- curities; lhog also further withdrow in small eums, about March, 1871, a furthor aggrogate of £70,000; all of which thoy applied to their own uso. Cushman was then the Treasurer, having chargo of all the socuritics, and Hardin was Vico-Presidont, baving active managemont of the affairs of tho Company; sud complainant charges that tho sid profended subscription for stock, and paymont of an mssossment smounting to £110,000 thercon, and the subsequent withdrawal of the 110,000 snd cancollstion of eaid stock, were nccomplishod by collugion with the oxecutive oflicors of tho Company, or some of them, and without the knowledge or consent of the bona fido atockholders, oxcept the executive officors aforosaid.
