Sutherland, * on behalf of himself end ell other unsatisfied persons equally inter- ested with himself, who shall come in and con- {ribate to the expensas of this Buit,” yosterday filed a bill in the Superior Court, praying that the Chicago Law Institute may be compolled to. render a full and perfect acconut of all the Iaw- books spd all the sums of monoy which,| wero sent to Chicago subgequent to the great firo of 1671, to tho Bar of tho city,’ 2nd also to the Institute for the use of said Bar, and a1l metters and things connected therowith, and that said books ané money moy bo placed in the possession and under the contzol af the said Bar of the city,.tobe controlled and taken care of as the mcmbeors of the Bar may seo fit; that the snid Tnstituto be restrained by injunction in sny woy refusing complainant, or persons equally intarested with himself, the privilege of looking 5t and using said books without cost, and for furiher relief. Complainant shows that in July, 1871, he be- ceme o practising lawyer of respoctability in the conrts of Chicago, and has becn continually since, and is pow, o lawyerof reepectability, prac- tising in 1l the conris of law, and also & mom- bor of the bar and legal profossion ; that on the 8th and 9th of October, 1871, nearly all the law offices of Chicago wero destroyed in the great fire, iwgluding the law-books contained therein, a8 we o5 the publio library, so-called, of the Chicago Law Insiitute; that nearly every Lawyer in the city lost all the law-books he pos~ sessed, the entire profession, 600 in number, being left entirely withont ‘books to aid them in tINr pursuits; that complainant’s law library was Of the valuo of €500, sud thst he was left entirely without the books necessary ‘o him to practice, and deprived of all his earthly pos- sossions except the suit of clothes upon his per- son; that the extent of the calamity caused by tho fire moved the whole world to =& geserons and indiscriminate sympathy for the sufferere, and also to & special sympathy for the unfortunate lawyers; and that, for many months afterwards, States, cities, snd individusls sent largoe numbers of fai-books, and large sums of money to bo used in jbo purchase of law-books, as s free Fift to tho lawyers of tho city who had lost thoir Iew-books in the firo, with the intent that such books should be placed in snd form a public Jibrery to be forever thareafter devoted to the froo tiee of each and every one of said lawyers, to psyment of the mDecessary eurrent espenses for taking care of ond keep- ing up said dopatod books snd library; and B AR, valov of such donated books, and tho money donated, aggregated $15,000, of which ‘donations was ono from the Hon. Joel Parker, %o the Mayor of Chicago, for the freo uso and benefit of the Bar of said city. b Farther, that & large proportion of gaid books 4nd money s seut to the Bar of Chicago by address, or io coriain individuals, for the free use and benefit of said Bar, and the balance to & certain corporation known as the Chicago Law Tpstitute, the latic, as the complainant charges the foct to be, for $ho freo use snd benm- efit of the whole Bar of the city; that the whole of said books and money so sent to the said Institute were forwarded with the bo- Tief and intention that they would in that man- ner more certainly reach the Bar; that, immedi- alely after the fire, tho members of the said In- stitute and their friends circulated statements turoughout the world that the said Instit.te contamed in its membership all or near- Iy sl of the membors of the Bar ot Chicago, thercby conveying the impren- sion sbrosd that sny fit of law-books sud mouey that might mede to the Said Institute would in _reslity be & gift to said Bar; and that John M. Wilson, a for- §er Judge of the Superior Court of Chicsgo, on the 95th of October, 1871, also sent out a circu- Jar asking contributions to the Bar uf the city, representing that tho_better way of scoding wauld be direct to sad Institute, 58 being the Surer way of reaching suid Bar, copics of which appeals were published ab the time in the city newspapers, and are familiar to the reader ; and subject, that in rospouso fo eaid sppoal many donstions were et to tho city; but complainant charges that it is' mot frue, 88 ropresented i soid appeals, that nearly all the lawyers of tbo city wore members ofsaid Tustituto, or that they afterwards became mem- ers, the fact being thet not moro_than 150 law- yors were members, out of tho 600 members of e Ber then practicing in the city ; snd he chnrges that not more than fifty members have Joined ths Instituto since the fire, and that even 1hose would not have joined had it not been for the conduct of said Institnte as hereaftor stated. Furiher, that said law-books and moncy, 88 they arrived, wero taken possescion of bY the £aid Institnto, and appropnated to the exclusive e and boneft of the members of said corpora- tion, tothe disregard of the rights of (ko Bar Who were not members, said instilution refusiug ever since to allow tho members of the Bar, not members of the Institute, to examine or in any way derive benefit from apy of such dona- tions, even on tho payment by esch of eaid lawyers of his pro rmts sharo of tho current expenses of caring for said books; hat tho institution is @ stock company, snd if one membor were fortunate enough to buy up the stock of the other members, he would become Lhe Institnto, and mij ropriste the whole of eaid property to his individual use. That, with the money thus donated, tho Insti- . tute purchased books, and added them to_their own private stock, tlien of the value of 2,500 y. . Complainant next gives as full a list a8 he can ocommand of the donation ethus received and ap- propristed by the Institute, and charges that oach donaticn was accompsnied by evidence that it was intended for the Bar gencrally, and not such members of the Bar only as belonged to the Institute. He then goes on to say that on tho 1st of March, 1872, he went to the rooms of eaid Institato, and took down from 1he shelves three law-books, part of the books donated %o the Bar, of which he was a membor, for the sole purpose of examining them, when an officer of gaid Institute told him he conld not look at said books unlees he became a member of the Institute, and complainant asked the terms of membership, which were stated at S25 per year for the first two years, and €25 per year, together with the assess- ments for the ncxt two years, $25 being paysble on joining, whereupon complain- Ent, refusing to becomo a member, was or- dored to leave, and afterwards, baving gone through s similar sceno with the libmxm,li:n, protesting thst he was willing {0 pay a fair charge for the cost of zeog:in the books, but wouwd not enter a close and high tariff corpora- . tion, since which pe-iod he Las never entered eaid rooms, or looked: st ssid books. Wright against the owners of the property lying betwoen Rapdclph and Madison stroets, snd betwoen Carpenter’s Addi- tion and Elizabeth street, in this city. This article sesumed to givo the names of the numerons owners, and such particulars as could only be obtained from persons who have made the subject & study, from which I infer that it originated with, and was prepared by, parties who have becn investigating this titlo for pur- poses which I refrain from characterizing as I think-hey deserve. Why you should bave published such an® article, attacking the titles of the ownors of mear §1,000,000 worth of prop- orty, in sdvance of any litigation, I cannot im- sgine, knowing, sa T do, that the propriotors of your paper are responsiblo for the dsmage you have done. 1 thick it due io innocont property-owners to relieve thelr minds from the apprehensions cre- ated by sour article, by stating that no such caso can bo made out 88 is presented by that article. The property in question belonged to John §. Wright, being & part of tho estato of Lis father. It was sold under exccution in favor of the Btate Bank of 1llinois. The certificate was sasigned and deed mads to Catbarina B. Tarner, who soon after becamo Mrs. Wright. The conveyances © by Mrs. Wright, at least for the morth half, and probably for all the property, wero duly 'mode and acknowledged. She was not forced to exe- cute thom by her husband. But, in addition, s full scswer to the pre- tendod claim is, that, by tho laws of Tllinois, Mre.
