C. Heald on the stand at the time of the adjournment. Before a dozen ques- tions had been propounded and an- swers it developed that the witness’ examination of the Teapot dome structure consisted of about four hours on the field and that at the time he made this examination there was snow on the ground. Fur- ther it developed that he was work: ing from an incorr-:t penciied map of the reserve and that certain Jands to which specific reference was made, and upon which Senator Walsh based most of his statements were not, as a matter of fact, in the ‘Teapot dome reserva at all, lying outside of that reserve. When the court convened on Mon- day, the room was well filled be- cause the outcome of this suit means a great deal to the future of Wyoming. Senator Pomerene made the opening statement for the gov- ernment. He stated the govern- ment would show the whole scheme contracts were made wholly with. out authority of law, because they were made without competitive bid- ding and because they provided for the erection of emergency tankage for the navy without competitive bid- ding. He further said the govern- ment would show the whome scheme ‘Was a conspiracy between Harry Sin- clair of the Mammoth Oil company, and former Secretary of the Interior Alber B. Fall. The contention made in the bill and one of the conten- tions of the government in the Do- heny case at Los Angeles that the presidential order transferings the administration of naval reserve lands to the interior department was secured through fraud and misrep- resentation made the president, has apparently been dropped. The defense reserved its state- ment until after the close of the gov- ernment's direct evidence. Edward F. Finney first assistant secretary of the,interior was the first witness called by the govern- ment. Little of importance from the standpoint of the government was secured from the witness, He stated that in the matter of looking after details of the leasing of the naval reserves and the cankage con- tracts that were involved with them the work had been divided in the oftice, he being given the California reserves. It developed on direct ex- amination of the witness that the so-called secrecy involved in these matters was due to a letter from As- sistant Secretary Roosevelt of the nayy department and that this se- crecy asked because, involved tn the transactions, were important war Preparedness questions, that is, the tankage, and that the interior de- partment naturally followed the re- quest made by the navy. During the cross examination of the wit- ness the full text of the Roosevelt letter was read into the record, The government brought out the fact that there had been a legal opinion to the effect that the law did not permit exchange of royalties for construction and special refer- ence was made to an opinion. of Osear Sutro of the Standard of Call- fornia, Judge Finney said he had argued this question with Stutro and that he, Finney, held to quite “ different opinion, and so informed Secretary Fall. On cross-examination it developed that Secretary Finney had been en faged in land law practices for great many years and that he w an expert on matters of this char- acter, dhe assumption being that he was far more competent to pas the legality of the law under wt the leases and contra than some attorney whose practice did not give him this peculiar know- ledge. It further developed on cross nination that it was Finney and not Fall who drew up the order for the president's signature to transfer administration of the naval reserve lands to the inte: department, this being done at the request of the navy department in order to prevent conflict of action, and that the navy might have the benefit of well equipped specialized departments of the interior, Commanders H. Landis of the navy, George Otis Smith, head of the geological survey, and Professor Heald were the other witnesses of the day. Little of any importance was received from any outside of Professor Heald. Commander Landis, under objec- tions of defendant’s counsel, was not permitted to answer certain ques- tions and was excused for the time being. The defense did not cross- examine either commander Stuart or Mr. Smith. Judge Finney, who was on the stand about two days in the Doheny California cuse and who there frankly said that it was he and not Fall who made the contracts with the Pan American interests, reiterated » that statement on the stand here.
