Gray,’ witness | |{n the open hearing investigation into kidnapping and slaying of Watt) Daniel and Thomas Richard, hooded| band victims, and directed that Gray should continue his testimony begun| yesterday. Judge Odom repeated his! ruling of yesterday, however, that Gray would not be required to answer questions that might inyolve state- ments of a possible incriminating nature. C, W. Barnett, as counsel for Gray, halted ‘proceedings when Gray was! recalled to the witness stand today| w; with an announcement that because of certain newspaper dispatches, taken to indloate that Gray might be made a defendant in criminal action’ and other testimony, he would decline to-answer further questions “for the reason his testimony might be used to ineriminate him.” Mr. Barnett declared his. client would invoke his constitutional rights in declining to testify. Howard Warren, special state's at- torney, Attorney General A. V. Coco and George 8. Guion and Paul Som- payrac, assistants to the attorney gen- eral, replied to Mr. Barnett and chal- lenged the right of the attorney to| 503 protest against the questioning. The contention was made that in the pres- ent proceedings, as solely of an in- quisitorial nature, the right to de- cline to answer questions rested with the witness himself. Mr. Barnett moe the assertion that the questioning in some instances had taken the form of @ third degree. | Attorneys for the state made vigoroun| denial that any such tactics were being employed. BASTROP, La., Jan. 18.—(By The William Higgen- Morehouse parish farmer, open hearing inquiry into the kidnaping and slay- ing of Watt Daniel and Thomas Richard, said to have been victims of a black hooded band, that Dr. I.
