As soon as the cement hardens the well, which held possibilities of being a ‘urge producer, will be completed and tested. During the spring months a deep test well to test out the Tensleep for- mation and the Amsden and Madison lines will be undertaken by the Iowa- Wyoming company. Preparations looking to an early pipeline market are based on the fact that the Midwest “Refining company has contracted to build a line before June 1. NEW YORK, April 10.—Extensive accumulation of buying orders over the week-end, infused further activity and strength to the general stock list at the outset of today’s trading. Rails supplemented last Saturday's gains, even the coalers ignoring latest as- pects of the strike situation Inde- pendent steels were the strongest fea- tures, Gulf States showing a gain of 2% points on the first transaction, but soon losing half its advance. SlAYER OF TAX DRAWER IS HELD BUNLTYBY JURY Twin Penalties for Earl Moss and Alfred Walker Asked of Cheyenne Judge in Petition. CHEYENNE, Wyo., April 10—As a reault of the conviction of Earl B. Moss of murder in the second degree, for the slaying of Louis Failer, Den- ver taxicab driver, by a jury in ‘the Laramie county district court here late Saturday night, an appeal will be made to Governor Carey to com- |mute to the same sentence imposed jon Moss the death sentence which is to be imposed on Alfred Walker, Moss’ companion in the, homicide. Walker was convicted of murder in the first degree, with capital punishment, but has not yet been sentenced. ‘The ap- peal in his behalf will be based on |the contention that his guilt and that |of Moss were equal and that it would be a miscarriage of justice to execute him while Moss was permitted to ex- |piate the crime merely with a prison | sentence. |The verdict in the Moss caso was returned at 11:45 o'clock Saturday night, after the jury had deliberated seven hours. The verdict of murder in the second degree was a compro- mise. Threo of the jurors early in the balloting voted for acquittal and an bert Walker, convicted murderer sa: i ntke witness chair here and told o: the slaying of Louis Failer, taxicab driver, by himself and Earl L. Moss, on trial for the crime. In his atti- tude was the suggestiontion of a hope that if his testimony might serve to send Moss to the gallows, he, himself, might hope to be saved from that fate—a fate he has faced since his conviction tast fall of murder in the first degree, with no saving clause “without capital punishment” attached to the jury's verdict. Should. that be his hope, and should it prove to be a hope well founded, only executive clemency may vring short the develop- ment he desires, for the verdict In his case means that he must be sentenced to death cn the gallows, the court of trial having no alternative under the law. That sentence was not long ago pronounced was due to his willing- 1e8s to act as a witness for the state in the present trial Moss heard Walker's @amning testi- mony without visible emotion. He stared continuously at the man on the witness stand, seenringly bent on gaz ing him out of countenance, but Wal ker returned his stare without a sign of cmbarrassmtnt. Throughout the ordeal for Moss his mother, Mrs. J Wilhoyt of Louisville, Ky. set with her arm across his shoulders, lending the solace of her caress to her “boy,” now barely 1% years old and just past 18 when Failer was ‘slain. Walker related how he and Moss soldiers of the Fifteenth United States cavalry, stationed at Fort Russell, had Janned to desert and had stolen two army automatic pistols with the in- tention of using them to hold-up a taxi- cab driver that they might steal his automobile and use it in getting away. They had no thought of murder in that connection he asserted, nor had they any especial taxicab driver in mind. Faller, himself, Walker sald, settle? whose taxicab was to be stolen and, incidentally enrolled himself as the victim of the murder, not at that mo- ment contemplated. fle he and Moss were walking about, Walker said, attempting to decide what driver they should approach, Failer accosted them with an inquiry regarding wheth- or they desired a taxicab. They said they did and employed him to drive them “out into the country.” When they had proceeded five miles trom Cheyenne, on the Fort Collins road, Walker testified, he engaged Faller’s attention by offering him a cigarette. Walker was seated beside the driver and Moss occupied the rear seat of the car. Failer’s hands wer engaged with the steering wheel, Wal- ker sald, so Walker held a match to the cigarette which Faller had accept ed and placed in his mouth. At that instant, Walker continued, Moss struck ‘ailer across the forehead with the arrel of Moss’ gun. The automobile vas climbing @ hill and as Failer lost ontrol under the shock of the blow the machine started to run backwards, down the grade. Walker leaped out, he said, and Failer followed and stag- gered away from the car, fumbling dazedly at a pocket. “I thought he might have a gun,” Walker said, ‘so I fired. He doubled up—on his hands and knees. Moss got out of the car and walked over toward Failer. He took a shot at him ane missed. Then he shot again and Failer sort o° rolled over on his side. Neither h> nor Moss touched Fatler efter he rolled over, Walker said, but at once got into the car, which had topped at the foot of the hill and fled into Colorado in the machine, later abandoning it in North Denver. Walker's statement regarding the cigarette which Faller was lighting at the moment he was attacked was sub stntiated by testimony of preceding witnessts, who related that a cigarette one end slightly charred, had been found inside Faller’s coat. This cig- arette was introduced as an exihibit. Walker underwent a protracttd cross-examination as calmly as he had testified under direct examination. The trial was continued Saturday. EMPIRE STATE.
