At the time Linn county voted on township organiza- tion the statute was in conflict with the constitution. The statute provided that a ma- jority of the votes cast on that one proposition was necessary to adopt it, while the constitution said that it required a majority of all the votes cast at the election. This de- fect in the statute was remedied by the legislature in 1902, and itis now in conformity with the constitution. The case decided was the proceed- ings begun by Prosecuting Attorney Berns of Linn county to oust M. L. Gibson, township clerk, and ex-officio assessor of Locust creek township. “The salient points in this contro- versy may be briefly stated,” sald Judge Burgess. “The constitution at the time of the adoption of town- ship organization by the counties of Barton, Bates, Caldwell, Carroll, Cass, Chariton, Daviess, DeKalb, Grundy, Harrison, Livingston, Linn, Mercer, Nordaway, Putnam, Sulli- van and Vernon, provided that counties might adopt township or- ganization ifa majority of all the votes cast at a general election should bein favor of such action.
