Washington, Dec, 5.—Attorney Gen- eral W. H. Moody, in his annual report } to congress recommends the enactment of a law which will provide in sub- Stance that where an indictment is! duly returned to a court of the United | States, the judge of that court may, in | his discretion, issue a bench warrant for the arrest of the defendants | wherever they may be found within the territorial limits of the United | States; and that it shall be the duty of all persons authorized to serve such process to arrest the persons or per- son indicted, and, if they fail after rea- sonable opportunity to furnish batt for their appearance, to bring them to the court in which the indictemnt | has been found. The attorney general explains that much embarrassment in ! the administration of the law has aris- en from the inability of the United States to bring an offender to the place and the court where, by the constitu- tion and the laws, the against him must be tried. By the} constitution the trial of all crimes must be held in “the state and dis- trict wherein they shall have been | committed.” It ‘frequently \hanppens | that persons accused. are not found within the limits of the district where | the offenses alleged against them are! triable. The frequency of such ab- sence increases with the gravity of the accusation, and where it consists in a conspiracy almost invaribly one or more of the alleged offenders are without the jurisdiction of the dis- trict. In support of his views Mr. Moody cites a number of cases under the pres- ent law in which justice has been de- feated or greatly delayed and large expense unnecessarily inevrred by the government. Among these cases. is that of the co-defendants with Capt. Oberlin M. Carter in the Savannah harbor improvement — frands, Mr. Moody ovtlines the proceedings and says that only alter oa delay of 26 months did the United States reach the point where, under the law, it wes permitted to take men charged with | © grave crime to the place provided by the constitution for their trial, Another case, he says, is that of George W. Ferguson, ot Oklahoma in his report to the secretary of the interior pre- sents a stroug argument in support of the territory's claim for statehood. A large part of the report consists of statistics indicating the extent of the territory’s resources and advancement during the last year. In his appeal to congress for favorable action on the statehood bill the governor says: “Oklahoma is the youngest child of that splendid family of _common- wealths bequeathed to our nation by the Louisiana purchase, but while it is last it is not least—not least in mor- al, intellectual and material develop: ment; not least in the diversity and greatness of resources.
