Rose of Iatan brought suit agamst the city for damages on account of injuries re- ceived by falling into a hole in a de- fective sidewalk. The doctors were unanimous in their opinion that he had received permanent injuries,and the jury awarded him $5,000. This was reduced by the judge to $2,500. An appeal was taken to the supreme court decision of lower court was affirmed. The city was finally compelled to levy tax to pay the judgment, and $1,000 was recently collected by Rose's at torneys who gave him notice. Upon receiving this notice yester- day Rose came to Atchison and sur- rendered to the sheriff, asserting and the a special taat he was a perjurer and should be punished.
