Hark- less, of this city; while D. J. Haynes and James Hagerman looked after the interests of the Kansas City and Sabine Pass raiload. During the forenoon a number of affidavits from both sides were read. The evidence deduced from the affidavits of the Kansas City & Sabine Pass was to the effect that S. C. Shaeffer and Morrison Munford had obtained quitclaim deeds for the contested right of way from the property own- ers, Mr. Munford afterwards deeding his interests in the same to S. C. Shaeffer. Mr. Shaeffer a few days gave a quitclaim deed to this road bed to the Kansas City and Sabine Pass railway for $1, stipulating in the contract that in case the con- trolling interest in the road should ever fall into the hands of John I. Blair or the Kansas City & Southern railway, or cars belonging to either avere allowed to go over the line, the same should instantaneously revert back to him. The affidavit filed by Colonel Wil- liam Bailey, president and general manager of the road; was of a sensa- tional character, and made rather se- rious charges. He openly charged that the whole scheme was a black- mailing one, concocted by these par- ties or the so-called Kansas City & Sabine Pass company, with the ob- ject to extort money from the Kan- sas City & Southern railway. He charged that 2 conspiracy had been formed by these parties with S. C. Shaeffer, who went into it on account of his intense hatred of John I. Blair, this hatred growing out of the arrest and imprisonment of Shaeffer for defrauding John I. Blair out of a large sum of money, and that three more cases are now pend- ing in the criminal court. - The affidavit of engineer B. R. Whitney, Sr., showed that the lines of the Kansas City and Sabine Pass went directly through the graded road of the Kansas City & Southern. The affidavit of Mr. E. R. Hickman showed that in 1880 he, acting as agent for the Kansas City & South- ern, had expended $2,130 in obtain- ing the same. Other affidavits showed that $2,000 had since been expended upon the road. It was further shown that in deeds made along the line exemptions had been made in reference to the road, as was the case in the particular deed Mr. Shaeffer received when he made the purchase of land on the Blue. After reading the affidavit Mr. O'Grady arose and said that he was convinced that it was a blackmailing scheme, and called attention to Mr. Fred M. Dey, of Buffalo, N. Y., who was present. He owns all but four shares in the road. Mr. O'Grady referred to the Kansas City & Sabine Pass company as being unable to build an inch of road. He then asked that Mr. Dey be sworn. Mr. Dey was sworn. He affirme: that he owned all but four shares of the stock. Mr. O'Grady asked him ifhe had the means to construct a quarter & Gilman, the contractors for the road, with a large force of men, reached the houses, and finding them in the way of theroad, gently carried them off and continued constructing the line. Tuesday night a gang of twenty negroes, hired by some one, picked the houses up and carried them back to where they had been originally. Loval Option Law. .To sum up the law in brief it is this: Druggists and pharmacists can sell or give away wine for sacrament- al purposes only; they can sell pure alcohol in quantities of not less than one gallon without a prescription for art, scientific and mechanical pur poses, and they can sell pure alcohol for medical purposes, upon a pre scription, in quantities less than one gallon. The selling or giving away or bartering directly or indirectly by any other person or in any other manner of any other kind of liquor, or ale, or porter, or any kind of liq- uor that is intoxicating or that can circumstances whatever, other than isa misdemeanor, punishable by a fine of three hundred to a thousand to a year or both.
