The court declined to grant an in- junction sought by William Randolph Hearst, the publisher, against the sen- ate lobby investigating committee's retention and use of Hearst telegrams taken from telegraph companies, It rebuked, however, the federal communications commission for copy- ing thousands of telegrams in com- munications companies’ files in 1935 and furnishing them to the senate committee, which is headed by Sen- ator Hugo Black (Dem., Ala.). The commission's acts were illegal, the court said. What the committee did after re- ceiving them was not a matter for the courts, the opinion held. Hearst's petition sought to enjoin the commission from giving any mes- sages to the committee and to re- strain the committee from using the Messages it had received; or from receiving others. Attorneys for Hearst announced immediately they would appeal their case to the supreme court.
