Sathre Wed- nesday announced that he would be- jgin a test suit in federal court chal- lenging the right of the federal treas- ury department to collect processing taxes on flour for wheat exchanged by the state mill and elevator at var- ious points in the state. Sathre said his action will be taken with authority of the state industrial commission in whose name the action will be instituted. Sathre declared that after exhaus- tive investigation he had “come to the conclusion that the regulation requir- ing mill door exchange will be ulti- ‘mately found unreasonable and burd- ensome by the courts.” Under present treasury regulations, the commission pointed out, a farmer may make exchange of wheat for flour without process taxes being imposed, only at the mill door. “The regulation,” the commission said, “works to deprive farmers par- ticularly in the western section of the state, who live at lengthy distances from the mill, of the right to exchange: their wheat for state mill-manufactur- ed flour. “The result has been to drive a large Share of the mill's business into other | exchange channels without any bene- {fit resulting to the fund from which the processing tax is paid.” | A. D., Oct. 30.—(7)— East Grand wounded critically here shortly after midnight Wednesday. J. J. Quigley, Great Northern switchman, fired the shot after he had been called to the side of his home by The woman Quigley’s story, verified by his wife and Mrs. Walter Quigley of Minne- apolis, is that after the woman streamed for help he went to the door with a revolver and saw her running from @ man. He ordered the man to halt, and the assailant crouthed in the shadow of his house. After some time, Quigley asked his wife if the police had been notified, she said yes and the man started to run, Quigley fired and the bullet struck McDonald in the back penetrating a lung. .His condition was reported serious at the hospital. Police are trying to locate the woman, Perry McIlwain, a companion of McDonald, said he does not know the name of the girl that was with McDonald at the time of the shoot- ing. McDonald pleaded guilty last August to a purse snatching charge. |Policeman Off Duty Captures Kidnapers Chicago, Oct, 30.—()}—Frank Fuerst, a policeman off duty, shot and captured two men who kidnaped him and Miss Margaret McNeil, 24, early Wednesday. Fuerst said Miss McNeil approached his car, held up by traffic, and told him two men were following her. The men, one armed with a pistol, ap- peared immediately, Fuerst said, and compelled the girl and him to sit in the rear seat of the patrolman’s auto- mobile. After driving for three miles, the policeman related, the robbers stopped the car and demanded Fuerst’s money. Fuerst drew his pistol and fired, wounding Irving Stark, 26, who the officer said was armed. A second shot struck Walter Weglarz, 21. Both men_ surrendered and were taken to the Bridewell hospital. Two U. S. Prisoners Held in County Jail Martin Freiz of Dickinson and Phillip Hausauer of Glen Ullin are lodged in the Burleigh county ‘jail serving federal sentences imposed by Judge Andrew Miller of Fargo. Freiz, charged with making liquor, must serve 90 days of a five-month sentence and Hausauer, accused of falsifying federal relief reports, must serve days of a six-month sen- tence.
