CREDIT COMPANIES ARE STILL IN COURT Fargo Loaning Companies will Be Sued in Mercer County Court in March Dismissal of the receivership of the Agricultural Credit Corporation and the Guaranty Credit corporation of Fargo by the supreme court Tuesday is only another step in what promises to be a long-drawn-out and hard fought legal battle, according to C. H. Sanders, who was acting as receiv- er under an order issued by Judge H. L. Berry of the Mercer county district court. The supreme court, in another de- cision Tuesday, upheld the right of Judge Berry to designate Mercer coun- ty as the place where an action was brought by borrowers from the two companies for 10 per cent of the amount of loans made by them. The complaint alleges the 10 per cent was paid for stock in the corporations and was to be refunded when the loans were paid. The borrowers claim in their suit that the 10 per cent was wrongfully converted by the two ag- ricultural credit companies. The companies appealed from Judge Berry's order that they be tried in Mercer county, where many of the borrowers live, claiming that their place of business was in Cass county and suit should be brought there. Sanders stated in Bismarck Wed- nesday that the action will be tried in Mercer county in March for $50,000, which is the amount involved. He said that the total assets of the cor- poration had been found to be insuf- ficient to pay the money back to the borrowers, but if the action in Mercer county is successful, efforts will be made to have the money of the bor- Towers returned to them.
