THE BISMARCK TRIBUNE, FRIDAY, AUGUST 25, 1933 6 NEW TRIAL ORDERED IN CASS LITIGATION Supreme Court Holds School , Board Not Liable For Al- leged Damages ‘The state supreme court Friday re- versed and remanded for a new trial an action brought by school district No. 35 of Cass county against Mike Shinn, Eugene Meehan and Carl Ost- wold, directors of the school district, for moneys alleged to have been spent by the school officers without author- ity. A jury in Cass county district court returned a verdict of $1,631.07 for the school district. It is alleged the school board mem- bers had expended funds illegally in payment of tuition to another school district; for operation of a school not properly organized; for attorney's fees and expenses incident to litigation; and in paying one of the members of the school board for services as an arbitrator on a division of the district. ‘The supreme court) held that no er exists for moneys expended in payment of tuition to another school district, for operation of the school within the ‘district, or for moneys paid for the! services of the arbitrator. The court ruled, however, there is sufficient evidence to make lit a question of fact for the jury whether funds expended for attorneys fees and expenses incident to litiga- tion were spent for the school district or for matters in which the district had no concern. The complaint against the school board members charged they had paid tuition for certain children living within the school district but who attended schools in Fargo. Minot Committee Is Praised by Governor i Governor William Langer Friday voiced his approval of the work ac- complished by the citizens’ flood con- trol and water conservation commit- tee of Minot in working for construc- tion of a darn in the Mouse river and recommended the approval of the pro- ject by the federal authorities.
