Langer, Thursday in removal proceedings against Max Wishek, Ash- ley, McIntosh county state's attorney. Briefs will be filed by counsel in the case before a decision is made by the governor. Wishek is continuing in office pend- ing outcome of the proceedings. E. R. Sinkler, Minot, represented Wishek, who attended the hearing. A. O. Gin- now, Ashley, and Y. D. Youcker, El- lendale, prosecuted the case. The request for removal of Wishek was brought by five petitioners who allege Wishek signed a county deposi- tory bond in violation of the 1927 law prohibiting county officials from sign- | ing such bonds. Sinkler told the governor the bonds’ sufficiency never had been questioned and it was signed in good faith and openly. He said former Attorney Gen- eral James Morris had approved the form of the bond and that attorneys consulted in the transaction were un- aware of existence of the law. Suf- ficient signatures were on the bond, he said, to have made it unnecessary for Wishek to sign it. The prosecution counsel emphasiz- | ed provisions of the 1927 law, assert- | ing signing of the bond was a viola- | tion and grounds for removal.
