Van Hook Indebted to McCurdy For Blood Transfusion Charges of misconduct on the part of a juror were advanced in district court here Saturday as a reason for judgment notwithstanding the verdict or a new trial in the case of F. E. Mc- Curdy, Bismarck attorney, vs. E. A. Hughes and George D. Mann. The misconduct alleged was that L. Van Hook, 523 Sixth St., a juror in the case in which McCurdy obtained @ verdict for $10,000 in a libel action against Hughes and Mann, failed to disclose the fact that he had received two blood transfusions from McCurdy. McCurdy, resisting the motions to Teopen the case, admitted through his attorney that the blood transfusions had been made but asserted the event took place in 1918, not 1929. Presenting the matter to Judge R. G. McFarland in district court, E. B. Cox and Alfred Zuger attorneys for Hughes and Mann, asserted it was ob- viously impossible for a fair trial to be had in view of the fact that a member of the jury had the plain- tiff's own blood in his veins. Cox was joined with Hughes and Mann as a defendant when the case was tried. but the jury found in his favor in its verdict.
