The action, a test case that will af- fect loans made by the 12 federal land banks of the United States, came be- fore the higher court on an appeal from a decision given by Judge Fred Jansonius in Stutsman county dis- trict court. He held on foreclosure of a mortgage and the bidding in of the land by the federal land bank for the amount due as a full payment of the loan, the borrower is entitled to a refund of the amount subscribed by | him for the stock. | ‘The suit was instituted by Edward} Byrne of LaMoure county. The ac-| tion involves but $500, the amcunt of the stock subscribed by him, and a} verdict in his favor was ordered} against the Federal Land Bank of St. | Paul and the Nortonville Nationa! | Farm Loan Association of Nortonville N.D. | Peyton R. Evans, Washington, pre-/ sented arguments in behalf of the Jand banks, while Martin P. Treerks,| Jamestown, argued for Byrne. | Byrne originally secured the loan| ‘of $10,000 from the Federal Land} Bank of St. Paul through the Nor- tonville association and _ received $9.500 and $500 stock in the Norton- ville Loan association. On default of | conditions of the mortgage, it was foreclosed and the land purchased by} the federal land bank at a foreclosure sale. Byrne alleges the federal bank can- celed his stock in the local association without refunding the money paid for the stock. Judge Jansonius held Byrne was entitled to a return of the $500 paid for the stock, and an appeal from that decision was taken by the/ publishing company, Des Moines, on | Jand bank group to the supreme! court. The court's decision is expected to, have far-reaching effect on loans/| from land banks throughout the! country, and counsel in the case indi- cated it may be taken eventually to! the United States supreme court. | Mr. Peyton argued that congress | intended the stock of the bank owned by the association to stand as security for the general debts of the associ-! ation and as a protective fund of the bond holders. ' Mr. Freerks in his arguments con- tended that when the sheriff's deed was issued on the foreclosure of Byrne's mortgage, Byrne ceased to be | @ member of the Farm Loan asso-} ciation. The amount of the stock, he | said, was not necessarily to pay a de- | ficiency as the land on the sale brought the full amount that was due | on the mortgage, and that the plain- | tiff was in the same position as if he had paid the mortgage.
