' TO 24-MONTH TERM G. L. Personius Must Pay Ber- nice B. Britton $925, Jury Decides Here Eugene Merritt Walla entered the state penitentiary at noon today to serve a sentence of 20 months. He was convicted of forgery in the third degree in Burleigh county dis- trict court July 4. The forgery charge resulted from a shortage in the funds of the Patterson hotel, Bismarck, where he was employed in 1927. He forged a bank deposit slip to deceive his employer and complaining witness, |° Edward G. Patterson, into believing that he had made a deposit to the credit of the hotel in a Bismarck bank. Patterson announced this inoentag that Walla would face further prose: cution in the near future on toegery ‘and other counts not made invalid when indictments were quashed. John Sullivan, special assistant attorney general assisting George 8. Linn pl Burleigh county state’s attorney, an. nounced in court today that the state ‘would esk for a change of venue for the further prosecution of Walla on forgery indictments. Walla was sentenced by Judge R. G. McFarland, Jamestown, at 10 a. m. today following arguments by Sulli- van and Charles L. Crum, defense counsel. Crum argued that the jury, in rec- commending the “utmost clemency” in the sentencing of Walla, had in mind @ suspended sentence. He pointed out that Walla already has served “al- most a year” in the county jail. He said he believed the jury finally came to a decision at noon, July 4, after considering the case for 18 hours, largely because members of the body desired to celebrate Independance day. He also claimed that a special talesman had much to do with the jury returning a verdict of guilty. Sullivan argued that the “utmost clemency” recommendation did not mean necessarily a suspended sen- tence. He said the recommendation, though it should be given weighty consideration, was nothing more than &@ “recommendation” and that the court would have to decide what the jury meant... He argued that, since ‘Walla was found guilty, he should be punished by a prison sentence. Sen- tence perniitted for third degree for- gery is not less than one year or more than five years. G. L. Personius, Bismarck, must pay Bernice B. Britton (Mrs. John E. Fleckten) $925, a jury decided last night after four hours consideration. MINOT BANK JOINS HUGE CORPORATION Minneapolis, July 24—(#)—The First National Bank of Minot, the oldest and largest bank in the north- western part of North Dakota, today became affiliated with the Northwest Bancorporation. The announcement was made by E. W. Decker, president of the corpora- tion and of the Northwestern Na- tional Bank of Minneapolis, its larg- est unit. The report came on the heels of the announcement that the Bancorporation had absorbed another North Dakota bank, at Valley City.
