Stewart, chairman of the board of the Standard Oil company of Indiana, was feached late today by the senate oil committee. Senator Walsh of Montan: the committee prosecutor, said he would seek to get action before adjourn- ment today and have the wealthy Chicago oil operator be- fore the bar of the senate to- morrow, there t: answer for his refusal to reply hefore the com- mittee to questions as to his knowledge of what become of the liberty bonds of the Conti- nental Trading company of Canada. Should the senate order the arrest, Stewart could apply to the District of Columbia su- preme court for a writ of habeas corpus and have a hear- ing in that court. Senator Walsh said that un- less he could show cause why the senate should not procced against him he would be re- manded to the custody of the sergeant-at-arms of the senate for such punishment as the law- making body might decree. The penalty under ci-il law is imprisonment in a common jail for not less than one month nor more than 12 months, and a fine of not less than $100 or more than $1,000. Washington, Feb. 3.—(?)—All the battering of Senator Walsh of Montana and the persuasivencss of Chairman Nye and other members of the senate oil committee failed today to shake the determination of Robert W. Stewart, Stand Oi magnate, to refuse to ques- tions concerning the disposition of profits of the Continental Trading company of Canada. Under a grueling examinatic.. in which various members around the committee table took turns in ex- amining him, Stewart talked freely up to one point, and that point was on whether he had had di d the profits of the Continental van their disposition with Harry F. Sinclair. There he raised a barrier which the committee could not surmount, try as it might. Declines to Talk To each repressed question touch- ing upon the phase of the case, Stewart replied that he respectful- 'y declined to answer on grounds weviously given-—that this story nust first be told to a judge and} jury. He is a witness in the Fall- Sinclair growing out of the lease of Teapot Dome to Sinclair. The government charged that $230,- 000 of the Continental profits went to Fall. Before Stewart was excused from the stand, Chairman Nye told him he must understand that the com- mittee must reach the conclusion that it was possible that he and his associates knew the of the Continental before it was or- ganized. The company, whose good faith was guaranteed by Stewart and Sinclair, bought 33,000,000 bar- rels ‘of oil for $1.50 a barrel and sold it back to Stewart and Sinclair companies for $1.75. “Have you any statement to make about thi Nye asked. Stewart was silent. Where Profits Went One of the final questions asked the witness dealt with the angle of the case involving whether any of the profits went to a political “Do you know anything about any of these bonds going to a political party?” Stewart was asked. “No sir,” he replied. | Before Stewart testified, several witnesses goa that they had heard a price of $1.75 was to be asked for |the Continental oil, as testified yes- jterday by Stewart, among em {Beman G. Dawes, of the Pure Oil company, a brother of the vice pres- jident. After Stewart was excused he was instructed to remain here juntil tomorrow.
