STATE RESTS | F CASE AGAINST W.V.O°CONNOR Defense Counsel Outlines Case to Jury at Grand Forks Just Before Noon Grand Forks, N. D., March 4—() +The state rested its case in the embezzlement trial of W. V. O’Con- nor at 11:40 this morning. | Francis Murphy, chief defense counsel, out- lined his case to the jury just before recess at noon. The jury was excused shortly be- fore the state rested. to allow Mr. Murphy to make two motions before the court. One was that testimony relating to certain trattsactions enter- ed in the name of O’Connor Brothers on the books of the First Savings Bank be stricken from the records, The other was a motion thai the court | return a directed verdict of not guilty on the claim that no embezzlenient of the bank’s funds had been proved in the evidence introduced by the prosecution. Both decisions were denied by Judge M. J. Englert. Mrs. Laura Stone, curt sten- ographer, was sworn in as a_wit- ness to read parts of the defendant's testimony given in the first trial of the case last February when the jury disagreed. The ruling on Mr. Murphy’s objection to this testimony on the first day of the trial was reserved, but today denied, und the extracts from O’Connor’s testimony were, read,. They showed that the defendant "had stated certain certif- icates of deposits used in the tran- sactions were written by himself and that he received the discounts on the he bought of Thomas Kady. H.
