The_accident occurred at Ball- club, a station west of Deer River. Merrill was lying on the track close to the section house at Ballclub. The section house is located on a- curve which the cident occurred. The engine struck Merrillon the head and cut a deep gash. The train was immediately stopped and the injured man was picked up and placed in the bag- gage car, where he was attended by Dr. L. A. Ward of Bemidji, who was among the excursionist. Merrill died after a few minutes and the remains were taken to Deer River. A bottleof whiskey found in 1 is pocket indicates that the dead man was drunk and laid down by the track to sleep.
