Under the present law, the fairness and equity of which are beyond question, so much so in fact that the law has been used as a model for several other states, the party who considered himself injured was obliged to ask for a retraction. If this re- traction was promptly published, the publisher was assumed to be guiltless of malice, but the party injured still had a right to recover for all actual damages. The party injured could, however, prove that the publisher was guilty of malice, and, if he estab- lished his contention, could, re cover damages. The prompt re- traction by the publisher of the matter complained of made a prima facie case that the puh. lisher had not wilfully or inten- tionally injured the complainant. The new law assumes malice in every libel. The publisher de- pendant on correspondents who may wilfully or carlessly betray his confidence, is liable to be in- flicted with damages that they are punitive. 2 The present Minnesota law is the admiration of the country, save those who desire litigation, and it would seem that the only object in eliminating the equitable features which it contained was to stimulate litigation.
