The theory upon which the grand jury was founded is that it should be a means of ferriting out erime and bring the criminal to justice. In practice the sys- tem simply retards justice; it is simply a cumbersome hopper through which all eriminal busi- ness must find its way; only in rare cases is it of any real use. The amendment to be voted upon this fall puts it within the power of the legislature to abolish the grand jury system except that the grand jury may still be called by petition or by order of the district court. The amend- ment if it carries will make it possible to expedite justice and will make criminal prosecutions far less costly.
