Before replying, in brief, to the personal attack of the company, I wish to make a few remurks upon Transit companies and ‘transit charters, which 1 own are not uriginal with me, being gathered from the morning papers of the past two years. Tue goverumenty of Nicaragua and Costa Rica are too ignorant to un derstand anything but hard money If you make a coutract with them you must fulfil it; you must pay your money and open yuur line, or step aside for your successor, The public may not perhaps be aware that the so-called American Atlantic and Pacific Ship Canat Company is not a ship canal company at all: the name 1s absurd. The revised charter signed by Senor Yrisarri in New York on the Lyth day oi Juve, 1867, apd subsequently confirmed by the government ot Nicaragua, Jaly 27, 1867, is a Trausit charter, aad releases the company from the obligation to make a ship canal, but obliges them to open a transi through Nicaragna in ninety duys. This term was extended. Extensions are generally fatal, much more to Transit companies than to merchants or bankers. “WE ARE CREDIBLY INFORMED.” After establishing the fact that I sold te them (on paper—acting for W. R. C. Wenster) the bouts on the river Sau Juan ond Lake Nicaragua, the com pany seys: “ And yet we are credibly intorined that the same James D. Whelpley is the author of the * as- tounding disclosures’ published in the newspapers.” ‘The press, or at least potit, very prompuy denies the charge—der bat Lum the author of the “ astounding disc! * 9 fatal to the eompa- ny. The company has thus drawn out two witnesses against itaelf: first, by attacking me, it admits my foreknowledge of the tacts; aud. second, by obliging the press to deny my authorship, it proves the exis- tence of another wituess. THK FIVE WITH FSSES The “ Act of Incorporation,” published last Tues- day, is prima facia evidence of the existence of a third wituess in the person of the Nicaraguan go verument. | am “ credibly informed,” to use the expression of the company, that that * Act of Lucor- poration” is a genuine document. 1 believe it t be such. [am not the possessor of WR. C. Webster's papers; consequently there iaa fourth witness against them in the person who holds those papers, whoever he may be, in New York. It is not the usage of Mr Horace F. Clark, or of Mr Vanderbilt, or of any of their “house,” to pablish their private business. Bat as they must have copies of the documents, it is probable that they could, if they chose, constitute themselves a fifth party in witness against the exi«t- ence of the Canal Company. I do not think that the company r- ceived $200 from the press for their defence of theur own life; it was not worth the money; the matter was neither brilliant, nor amusing, nor at all “as tounding” to anybody. No doubt 3200 is a large, even an astounding sum of money, in the eyes of the Atlantic and Pacific Ship Canal Company; bat it is not 60 to the presa of New York. Thousdods have been paid for the ex ire of the swill milk business; the same money wested in the ex; of Transit financiering aud pecalation would, | believe, work an equai benefit to ‘the nation. HOW THR COMPANY APPEARED. The Qessantine restrictions imposed pon vessels coming into port are not alone vexatious aud bur densome to those who are engaged in the West [ndia trade. The Kurepean packet ships which are ea- gaged in the emigrant passenger busiuess are very often subject to as much, if not more detention than any others; and this happens when these ships bring | into port one or more cases of smallpox. But, notwithstanding these restrictions are dificult to | bear on the part of the owners and consignees of ves- | +eis, they are of the utmost consequence to the pub- lic, as the following case and its remarkable results most clearly indicate. The ship Republic arrived in port from Bremen on the 26th ult., with adont 300 passengers and two cases of smallpox—one in the person of an infant, who was nearly well on ar rival, aud the other m the person of a girl of eighteen, npon whom ovty a few pimples apppeared. ‘This was but a slight manifestation of the disease, and apparently scarcely enough to merit severe and rigid restrictions; yet all the passengers having been exposed to these two slight cases of smallpox, the health authorities, ay a matter o safety, ordered the passengers to be vaccinated, and sent them ou shore, ty be detawed for a period of five orsix days.
