THE NEW YORK SUN. eneergeereees pennant eee = FEIDAY MORNING, JAN, 5, 1860, Tan recess of Congress expired yesterday, and to-day the requ'sr business of the semon will be resumed, provided that « qnorum of members hall be present. During the iatermission people have hed smpie time to read and consider the va- hous pablic documents from the President and bis Geténet, and bave had» chance also to watch the tem per of the unreconstructed Biates concerning the ection of Congroes relative to them. They Lave carefully noted every evidence of @ refractory (is- poaition among the late revela; they bare closely ecrutinined the manner in which the free!men Dave lately been treated, and they have bad good facilities geners!ly for forming opinions in respect & the proper course which Congress should pursue upon the subject of rebabiilitation. The members of Congress who hav: spent the holidays at home emong their constituents, wil therefore vesume their seate in Congress with & Detter understanding of what the country expects (rem them ; and if they fail to take the proper course it wi be beosuse of disregard for those who placed them in power, There may be much diversity of opinion among the people con- serning specific questions relative to reconstruc. hon, bet we think there iano reason to doubt the general course that is thought to be most advises dle. We believe that the groat mens of the poople, regerdiess of party distinctions, are opposed to the the extreme doctrines of Srevers and fuMsEa, which at the opening of the session found # much favor with the Houses of Represevtat ves, Ov the other hand, we are of the opinion that ail careful, ealm and unprejudiced thinkers, who have the parmppent imteres's of the Baion at heart lave eter the necessity of loosing the government reins upon the Bouth with less precipitancy, than hes been laiely exhibited by the Executive. The poople appreciate the desirability of having the functions of the Southern States completely restored at the earliest practicable moment; lub with # jesloun regard for the future, they believe that it le not good policy to be hasty in removing Government surveillance from the Bouth while Ot ful sparke come up from, the embers of rebellios. Congreas will now be expected, therefore, to re- fleet the sentiments of the people, I’ they slall biander, either from personal prejudices or in- competency, they cannot fail back upon the excuse that they wore unadvised respecting the wishes uf their constituents, We hope that they will now resume the business of th» session promptly ao! vigorously, and that they will show better evi- dances of wisdom and discretion thau they exbi- New Yerk Canal Kystem. Tas report of the Cans! Auitor of this State topnvinces us thatgNow York should do one of hese three things, with the least possibls delay: Firs. eel the Stats canals for whatever they will bring. Becond, if they will not sell, give them away. Third, if nobody will take them as « present, hire womebody, as as lows figure as possible, to take them as @ gift. The report of the Canal Auditor certainly warrants the plan suggested. It shows @ deficiency in the caval revenues amounting to $1,716,150, of which smount 1,249,000 must be met by spocial taxation, which will sweil the slroady beavy burden upon the Btate to the extent indicated, Now where is the cause of this deficiency ? Evidontly in the wholesale ewindling of caval officials, for the report shows that the cost of repairs for the year is equal to more than half the entire recetpte for tolls, The evidence of fraud in such an exhibit as that, is too palpable to adnutof question. But, nevertheless, there is the deficiency, and the money to moet it has got to be raised. Well, shall ne have a logis- tatiwo inves\ galing commities to ferret out this evindle aud bring the derelict afcials to justice ? N . Experience has shown that such an inves i- vation would only add epother heavy expense to the Btate, and be productive of nothing bus w whitowashing report. The bess thing that the Btate can do sbout the matter je to foot the bill with es good grace as possible, and then ges the canals off its hence, They always bave been, and always sill be, a Crawback upcn the State, and so long as they ere conducird as a State institution they wil ouly serve as a means for the enrichment of swind- (ng agente. Pooneylvania ran up « Btate debt of over forty millions mainly through {ts canals, ei at last it leased them to companies. The canals @ once became profitable invesiments, and now the State receives a hendsome revenue from them. Tree years ago Ohio did the same thing, after sutlering for years from eanal deficiencies. The only remedy for Now York isto follow the exam- pleof Penvsylvania and Obio, and the report above alluded to shows that the action caunos be taken woo so0n. The strong Divorce sult. Tt was hopod that after the five weekaof unen- valle prom nence which the Birong 4 vorce case enjoyed during the late trial, it would pass from view aud forever remain in that obscurity trom which it never oaht to have been allowed to emerge.
