~ STATE RENT LAW 18 DEFENDED WN ‘public buildings were pressed into U,S. SUPREME COURT : —_—_ é William D. Guthrie Contends It Was Properly Passed to Remedy a Public Evil. ‘WASHINGTON, Jan. 26.—Argu- tment in the New York rent case, Kkmown to the Supreme Conrt as Ed- gar A. Levy Leasing Company, plain- Mf im error, vs. Jerome Siegel and “#20 West End Avenue vs, Henry R. @tern, has been concluded. Argu- (ment for the State wae made by William D, Guthrie and Julius Henry @ohen and the conclusion for the Plaintiff by Louis Marshall. Chief Justice Taft and Associate ustices Brandeis, Van Devanter, Mc- Benna.and Holmes asked questions Pegarding former opinions and cita- fiens. One or two questions asked by Justice McKenna indicated he thought the New York law was an fufrmgement on property rights, Mr. Guthrie said no case before the Supremy Court was more important han this, “Census reports show that a major- ity of the people dwell in cities and that the entire character of the coun- try has been changed because of this fact,” he said. “We are at an awful ‘erisis in New York, but under the new faw the problem is solving itself,”" ‘Mr. Guthrie said much testimony on tue subject had been taken before a legislative committee and the lower cou;ts. Chief Justice Taft inquired if the facts brought out in hearings were before the court. Justice Holmes ex- plained that some of the facts were Presented to the court in a former "Yes," added Mr. Guthrie, “facts dave been presented in another case ‘and we think the court should accept the statement of the New York Legis- lature.”" Mr. Guthrie argued that an emer- existed when the New York it Law was passed and that it was tutional, “If no compelling necessity had existed,” said he, “this legislation ‘would be unconstitutional. We con- tend that the means were properly adopted to remedy the public evil. No question before the New. York Legis- lature has been so thoroughly inves- tigated before action as this.” “The law is fair,"’ said Mr. Guthrie, *ncreases in rent have been allowed. Ta some instances it has been found that the profits made were 70 per cent. There has been an adjustment of rent charges. A tremendous in- crease in building has come because Of this law. It bas relieved the crisis and will further relieve it if this court ecides in our favor.” Mr, Guthrie drew a picture of con- @itons in New York City as they were found by the Calder sub-commhittee of the Senate and other investigating bodies. He said armories and other pervice and that the Governor of the Btate was in apprebension of disor- @er, riots and other breaches of the Peace. “Our problem was,” said he, “to pro- faci the homes of New York. Hordes of newcomers who had more money Sought to oust those who were already there. That was the state of affairs ited to the Legislature.” "| In concluding, Mr. Guthrie declared the fundamental fact to be considered ‘Was as ‘to whether or not an emer- gency existed.
