RFE POLICEMEN TRIALS POSTPONED TOTAL OF 49 TMES Prosecution Never Ready in Cases Against Gunson, Franklin and Moloney. Recorda revealed in the Court of General Sessions to-day before Judge Crain that John J. Gunson, Frederick % Franklin and Joseph Moloney, Po- MCB Department detectives, indicted eleven months ago on charges of bribery and extortion on evidence produced by Assistant District At- torney James E, Smith, have been called for trial a total of forty-eight times, and that on each occasion, al- though the defendants wére ready, a Postponement was obtained by the District Attorney's office. And when they were called for trial to-day As- sistant District Attorney Cunneen an- nounced that the prosecution was not ready. “This is an intolerable state of af- fairs,” said Judge Crain. “These trials must proceed. The clerk will mark them ready but pass them for the day.” Franklin has been called for trial twenty-three times, Gunson sixteen times and Moloney nine times. The three men are under suspension from the Police Department. Frank Aranow, counsel for Frank- Yin, sald his client ta destitute. Be- cause of the frequent calls upon him for attendance at court he has been unable to hold a Job. Counsel for Gunson said his client is in the same state, It was police morning in Judge Crain's court Capt. William a. Bailey, under indictment on the e of the acceptance of an un- lawful fee, appeared with counsel, a representaive of William Fallon, and demanded an immediate trial.
