$1,000,000 SECRET 10 LAWYERS AT MURDER TRIAL Assistant for Waxy Gordon Clash and Are Cited for Contempt. For ten weeks the trial of Irvini ~ OF YEAST MAKING SAVED TO OWNER Austrian Shows Fleischmanns Copied Beet Process Plans and Gets Injunction. of the General Seastons. A remarkable story of how Theo- | naon @ore Stein, an Austrian, discovered through thumb tack holes that his original secret plans for the making of yeast from sugar beets had been ddplicated dnd a secret formula cop- fed by Dr, Alois Zeckendorf, chief chemist and general manager of the Fleischmann Company, a $30,000,000 yeast manufacturing concern of Cin- cinnatt, O., came to light in the Su- preme Court to-day. Braving the risks of warfare, Stein, the papers disclose, went to Austria in December, 1915, to learn from inti- mate! friends the secret ef making yeast from sugar beets, Scientists of Vienna discovered the process when the war forced breadmakere to abandon thé use of cere nd pota- toes in yeast making. The plans were worth a million dollars, Stein told the Court. Upon his return to this country tn October, 1916, Stein, who ts related by marringe to Julius Fleischmann, head of the yeast concern and former Mayor of Cincinnati, called upon Dr. Yeckendort and offered him the plans for inspection, believing they would revolutionize ¢he methoda used by the company. On Nov. 1 Stein de- posited the plans with Dr. Zacken- dort. They were to remain a week with the chemist. At the expiration of that time the plans were returned to Stein with the explanation that hig secret formula was of no use to the company. “I wem home with my plans, greatly depressed,” Stein tokt Referee A. Walter Otis. “I took the papers out of the folder and while I was ox- améining them I noticed that the el tate light in my room was shinin through little thumb tack holes in the corners. I concluded they had been copied, though I was not sure. “Barly the next morning I went to Dr. Zeckendorf's office. On his desk were copies and blueprints of my plana I bad an office employee of the company receipt for the copies and I took them away.” Other witnesses, including Dr. Zeck- endorf, who were heard by the ref- eree testified that the company’s architect Jackson, aided by another architect, Surman, spent nights copy- ing the plans at the request of the chemist, The specifications and secret formula were éopied by Miss Sov gad stenographer to Dr. Zecken- 01 dort. : Other evidence showed that on the day the copies were taken away by Stein, Dr. Zeckendorf called him on the phone and told him they bad been copied. The referee found that Dr. Zeckendort had discovered the ab- sence of the plans and hastened to reassure Stein. “The copied drawings, plans and blue prints,” the referee finds, “were made for the purpose of being kept by the Fleischmann Company in case Stein did not discover that they had been made, This I consider to be a gross fraud upon Stein who never in- tended that they should be copied.” The action upon which the matter ney tor the benefit of the jury. “That‘a a ite!” snapped Fridiger. in @ loud tone. 5th Avenue was sent to a refereo. was an tnjunc- tion sult brought by Stein to restrain ihe Fleischmann Company from using the plans.
