isk gens peel’ ‘2 RSS ARE ANEN FT ~ GET POLE Counsel for Czar’s Govern- ment Asks for More Time to Produce Evidence, f THE REFUGEE OBJECTS. His Lawyers Assert That the State Department Is Inter- fering in the Case, The Russian Government, through its counsel, Frederic R, Coudert, asked for a sixty days extension of time 4n which to get the evidence from Rus- sia to prove that Jan Pouren, the refugee, was guilty of extraditable of- fenses and should be deported to stand trial in Russia, The motion was op- | posed by Simon Pollock and Prof. Isaac ' Hourwich, appearing for the defendant. Prof. Hourwich declared that the Rus: . slan Government had far exceeded the jwtime that should be allowed to prepare | the case. He contended that the limit was forty days from the time of the man’s arrest and that a further exten- sion of twenty days was all that could be granted. The case has now been on for more than four months, and he asked United States Commissioner Samuel M. Hitchcock to close the cage at once. State Department Ploa. Mr. Coudert and his assistant, John Murray, brought out the point that the State Department had asked that the Russian Government be given every op- portunity to get in Its testimony, As- sistant United States Attorney Dorr was present on behalf of the State Depart- ment. In rebuttal Prof, Hourwich declared that the department had no right to in- terfere after the proceedings had started, and in corroboration of this he produced a letter from Elihu Root, dated Jan. 19, in which the Secretary of State said - that the department and the President had no right to interfere !n the cage, as it was following the usual Judicial course and the executive branches had no authority to infringe upon the pre- rogatives of anather branch of the Government, This letter was written to President Roosevelt when he referred to the « Department a petition from the American Federation of Labor pleading for clemency for Pouren The defendant's counsel contended that as the State Department had no Authority to interfere after the matter ‘wae placed in the hands of a United Btates Commissioner, tt had no right to thrust i{tself into the case, pract!- cally as an ald to the Russian Govern: ment. No Mention of Roosevelt. He made no mention of the fact at the hearing to-day that the chief coun- fel for Pot Herbert T. Parsons, had conferred with President Roosevelt about the case two weeks ago, and the President at that time had promised to take the matter up with Secretary Bacon, When questiorpd before the hearing, Prof. Hourwich stated that they had heard nothing about the mate ter since that time.
