LESSON NO. 11. Fire and Folice Service. eegeg] 2 will resumy our discussion of the answer to the question > three branches calling for of the Stu with their functions heading marked A we con the functions of the legisiative bri (B) The second main branch of the Gtate government 1s known as the executive branch. It includes the Governor, who 1s known as the Chief Executive of the State, as well as the heads of the various State departments, such as the In- surance Department, thy- Banking Department, the State He: partment; the heads of w known sometimes as comm commissioners, sometimes intendents; together w subordinates and employees Functions of this Branch. The functions of this branch of the State government are not mérely to enforce the Constitution and the laws, the full responsibility for whioy does. not rest upon this branch, but also to administer ail the business transacted by the State @s such. This it does throug! the various departments named and nu- merous other departments and bolies: hence these departments are often referred to as administration departments. Thus the question might be asked, what are the ad- ministrative departments of Btate government, etc.? We sh @escribe them more fully later on. It-is enough here to give as above, @ general idea of what they are. Another distinction is important here. In the enforcement of the Jaws, both criminal and civil, the executive branch of the State gov- ecnment has the help of purely local officers, District Attorneys and sheriffs, for Instance, and, in cities, tho Mayor and the Pollce Depart- ment, whose duty {t becomes to en- force general State laws, as well as local regulations. All these are made 1n some measure amenable to State @nd county, and most of them are removable by the Governor, the chief executive. But the spirit of our laws 4s such that all the affairs that con- cern only the people of a given local- {ty or communtty are regulated and controlled ao far as possible by the people of that community, This is what 1s frequently referred to as the Principple of “home rule.” $0 it comes about, for instance, that here on Manhattan Island we are looked after by four distinct sets of officials —belonging to as many distinct sys- tems of government, national, State, Care of the way in which we erned to keep these various systems distinct In your mind. It consists of the system courts, both civil and whether of original or jurisdiction (that 1s, whether for the of cases or for the hearing of als), together with the judges, ficers and employees of the same; and the function of said courts !s to interpret the law. Two things are meant by the ex- pression “interpret the law." One is to determine whether or not @ given law (act of the Legislature) Is con- stitutional; that is, whether {t runs contrary to any of the general pro- ns of the Constitution, and ‘s therefore void in whole or in part. The other ts to determine !n what manner the law, as it exista, applies to a given state of facts presented in court by means of evidence. This embraces the trial of all actions, civil criminal. The principle is the same the People of the State of New York accuse John Doe of mur- der, or whether John Smith accuses John Brown of buying goods and not paying for them. The fune- tion of the court is to determine whether the facts as established come within the laws of homicide, in the one case, and within the law of contracts, In the other. ‘As in the case of the executtre) distinction 1s to De noted be- courts, which embrace all ed for in the Constitution, jurtsdiction—that {, Jurisdiction over! ause the counties are really only sub-| ns of the State, and these courts provided for In the Constitution. ever, these distinctions are of to our friends the can- attendants, and tf vou LOUISIANA NOT “DRY.
